SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/21-7   from Ch. 38, par. 21-7

    Amends the Criminal Code of 1961. Makes a criminal trespass to the restricted areas and restricted landing areas of an airport a Class 4 felony (instead of a Class A misdemeanor). Makes criminal trespass to the restricted areas and restricted landing areas of an airport while in possession of a weapon, replica of a weapon, or ammunition a Class 3 felony.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by changing
5 Section 21-7 as follows:
 
6     (720 ILCS 5/21-7)  (from Ch. 38, par. 21-7)
7     Sec. 21-7. Criminal trespass to Restricted areas and
8 restricted Landing areas at airports.) Whoever enters upon, or
9 remains in, any restricted area or restricted landing area used
10 in connection with an airport facility, or part thereof, in
11 this State, after such person has received notice from the
12 airport authority that such entry is forbidden commits a Class
13 4 felony A misdemeanor. Whoever enters upon, or remains in, any
14 restricted area or restricted landing area used in connection
15 with an airport facility, or part thereof, in this State, while
16 in possession of a weapon, replica of a weapon, or ammunition,
17 after the person has received notice from the airport authority
18 that the entry is forbidden commits a Class 3 felony. Notice
19 that the area is "restricted" and entry thereto "forbidden",
20 for purposes of this Section, means that the person or persons
21 have been notified personally, either orally or in writing, or
22 by a printed or written notice forbidding such entry to him or
23 a group or an organization of which he is a member, which has
24 been conspicuously posted or exhibited at every usable entrance
25 to such area or the forbidden part thereof.
26     The terms "Restricted area" or "Restricted landing area" in
27 this Section are defined to incorporate the meaning ascribed to
28 those terms in Section 8 of the "Illinois Aeronautics Act",
29 approved July 24, 1945, as amended, and also include any other
30 area of the airport that has been designated such by the
31 airport authority.
