AMENDMENT TO HOUSE BILL 452

2     AMENDMENT NO. ______. Amend House Bill 452 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Tanning Facility Permit Act is amended by
5 changing Section 25 as follows:
 
6     (210 ILCS 145/25)  (from Ch. 111 1/2, par. 8351-25)
7     Sec. 25. Operating requirements.
8     (1) Each tanning facility shall have on hand at all times
9 an operator adequately trained in the correct operation of the
10 facility so as to be able to inform and assist the public in
11 its proper use. Each operator shall perform the following
12 functions as a precondition to the public having access to the
13 tanning facility being made to the public:
14     (a) The operator shall require each person desiring to use
15 the facility to fill out a form specifying any and all
16 prescription medicines and over-the-counter medications they
17 are presently taking. The form shall be kept as a permanent
18 record of the individual's attendance and progress.
19     (b) The operator shall require each person desiring to use
20 a tanning facility to use protective eyewear.
21     (c) The operator shall instruct the user in the proper
22 position to maintain in relation to the tanning lamps within
23 the facility; the position of the safety railing, if
24 applicable; the manual switching device to terminate the

1 radiation in case of emergency; and a recommended time of
2 exposure.
3     (d) The operator shall monitor the use of the facility to
4 ensure that the interior temperature does not exceed 100
5 degrees fahrenheit or 34 degrees centigrade.
6     (e) The operator shall inspect the facility to ensure that
7 the floors are dry. The floors are to be made dry prior to each
8 individual's use.
9     (f) The operator shall give each person using the facility
10 a written copy of the warning required under subsection (h) of
11 Section 20 of this Act prior to each person's use of the
12 facility. The operator shall post signs warning consumers of
13 the potential effects of radiation on persons taking medication
14 and the relationship of radiation to skin cancer.
15     (g) The operator shall be responsible for proper sanitizing
16 procedures for all sunlamp equipment and protective eyewear
17 between every user.
18     (2) A tanning facility may not allow any minor under 14
19 years of age to use a tanning device, either alone or in the
20 presence of another individual. Before allowing a minor who is
21 at least 14 years of age but less than 18 years of age to have
22 access to a tanning device, a tanning facility must obtain the
23 written consent of a parent or legal guardian of the minor
24 consenting to the minor's use of the tanning device. The parent
25 or legal guardian must sign the consent form in the presence of
26 a tanning facility operator who is not a minor, indicating that
27 the parent or guardian has read and understood the warnings
28 required under subsection (h) of Section 20 or in rules adopted
29 by the Department. The parent or guardian shall not be required
30 to be in the tanning room or booth with the minor.
