AMENDMENT TO HOUSE BILL 991

2     AMENDMENT NO. ______. Amend House Bill 991, AS AMENDED,
3 with reference to page and line numbers of House Amendment No.
4 1, by replacing everything after the enacting clause with the
5 following:
 
6     "Section 1. Short title. This Act may be cited as the
7 Asthma Inhalers at Recreational Camps Act.
 
8     Section 5. Definitions. In this Act:
9     "Physician" means any physician or health practitioner
10 with the authority to write prescriptions.
11     "Recreational camp" means any place set apart for
12 recreational purposes for boys and girls. "Recreational camp"
13 shall not apply to private camps owned or leased for individual
14 or family use, or to any camp operated for a period of less
15 than 10 days in a year.
 
16     Section 10. Possession, self-administration, and use of
17 epinephrine auto-injectors or inhalers at recreation camps.
18     (a) A recreation camp shall permit a child with severe,
19 potentially life-threatening allergies to possess,
20 self-administer, and use an epinephrine auto-injector or
21 inhaler, if the following conditions are satisfied:
22         (1) The child has the written approval of his or her
23     physician and the written approval of his or her parent or

1     guardian.
2         (2) The recreational camp administrator or, if a nurse
3     is assigned to the camp, the nurse shall receive copies of
4     the written approvals required under paragraph (1) of
5     subsection (a) of this Section.
6         (3) The child's parent or guardian shall submit written
7     verification confirming that the child has the knowledge
8     and skills to safely possess, self-administer, and use an
9     epinephrine auto-injector or inhaler in a camp setting.
10     (b) The child's parent or guardian shall provide the camp
11 with the following information:
12         (1) the child's name;
13         (2) the name, route, and dosage of medication;
14         (3) the frequency and time of medication
15     administration or assistance;
16         (4) the date of the order;
17         (5) a diagnosis and any other medical conditions
18     requiring medications, if not a violation of
19     confidentiality or if not contrary to the request of the
20     parent or guardian to keep confidential;
21         (6) specific recommendations for administration;
22         (7) any special side effects, contraindications, and
23     adverse reactions to be observed;
24         (8) the name of each required medication; and
25         (9) any severe adverse reactions that may occur to
26     another child, for whom the epinephrine auto-injector or
27     inhaler is not prescribed, should the other child receive a
28     dose of the medication.
29     (c) If the conditions of this Act are satisfied, the child
30 may possess, self-administer, and use an epinephrine
31 auto-injector or inhaler at the camp or at any camp-sponsored
32 activity, event, or program.
33     (d) The recreational camp must inform the parents or
34 guardians of the child, in writing, that the recreational camp

1 and its employees and agents are to incur no liability, except
2 for willful and wanton conduct, as a result of any injury
3 arising from the self-administration of medication to the
4 child. The parents or guardians of the child must sign a
5 statement acknowledging that the recreational camp is to incur
6 no liability, except for willful and wanton conduct, as a
7 result of any injury arising from the self-administration of
8 medication by the child and that the parents or guardians must
9 indemnify and hold harmless the recreational camp and its
10 employees and agents against any claims, except a claim based
11 on willful and wanton conduct, arising out of the
12 self-administration of medication by the child.".
