AMENDMENT TO HOUSE BILL 1044

2     AMENDMENT NO. ______. Amend House Bill 1044 by replacing
3 lines 21 through 30 on page 1 and all of page 2 with the
4 following:
 
5     "Section 15. Reporting of employer-provided health
6 insurance information.
7     (a) Notwithstanding any other law to the contrary, the
8 Department of Public Aid or its successor agency, in
9 collaboration with the Department of Human Services and the
10 Department of Financial and Professional Regulation, shall
11 annually prepare a public health access program beneficiary
12 employer report to be submitted to the General Assembly. For
13 the purposes of this Section, a "public health access program
14 beneficiary" means a person who receives medical assistance
15 under Title XIX or XXI of the federal Social Security Act.
16     Subject to federal approval, the report shall provide the
17 following information for each employer who has more than 100
18 employees and 50 or more public health access beneficiaries:
19         (1) The name and address of the qualified employer.
20         (2) The number of public health access program
21     beneficiaries.
22         (3) The number of public health access program
23     beneficiaries who are spouses or dependents of employees of
24     the employer.
25         (4) Information on whether the employer offers health

1     insurance benefits to employees and their dependents.
2         (5) Information on whether the employer receives
3     health insurance benefits through the company.
4         (6) Whether an employer offers health insurance
5     benefits, and, if so, information on the level of premium
6     subsidies for such health insurance.
7         (7) The cost to the State of Illinois of providing
8     public health access program benefits for the employer's
9     employees and enrolled dependents.
10     (b) The report shall not include the names of any
11 individual public health access program beneficiary and shall
12 be subject to privacy standard both in the Health Insurance
13 Portability and Accountability Act of 1996 and in Title XIX of
14 the federal Social Security Act.
15     (c) The first report shall be submitted on or before
16 October 1, 2006, and subsequent reports shall be submitted on
17 or before that date each year thereafter.".
