SYNOPSIS AS INTRODUCED:
 
30 ILCS 500/25-70 new

    Amends the Illinois Procurement Code. Requires that electronic mail service provided under State contracts must be provided reasonably free of unsolicited electronic mail advertisements (sometimes known as "spam").

1     AN ACT concerning procurement.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Procurement Code is amended by
5 adding Section 25-70 as follows:
 
6     (30 ILCS 500/25-70 new)
7     Sec. 25-70. Electronic mail service; spam free. Electronic
8 mail service providers that provide electronic mail service
9 under State contracts awarded on or after the effective date of
10 this amendatory Act of the 94th General Assembly must take
11 measures reasonably designed to provide a service that is free
12 of unsolicited electronic mail advertisements (sometimes known
13 as "spam"). The electronic mail service provider is responsible
14 for using software filters or other means to accomplish the
15 requirements of this Section. In this Section, the terms
16 "electronic mail service", "electronic mail service provider",
17 and "unsolicited electronic mail advertisement" have the same
18 meanings as those terms are defined in the Electronic Mail Act
19 (815 ILCS 511/).
