AMENDMENT TO HOUSE BILL 1450

2     AMENDMENT NO. ______. Amend House Bill 1450 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Mental Health and Developmental
5 Disabilities Administrative Act is amended by changing Section
6 18.3 as follows:
 
7     (20 ILCS 1705/18.3)
8     Sec. 18.3. Integrated system for services for the mentally
9 ill. The Department shall develop an effective, recovery
10 oriented, integrated system for delivering State-funded and
11 State-operated services to persons with mental illness. The No
12 later than June 30, 1994, the Department shall enter into one
13 or more cooperative arrangements with the Department of Public
14 Aid, the Department of Rehabilitation Services, the Department
15 of Public Health, and any other appropriate entities for
16 administration or supervision by the Department of Mental
17 Health and Developmental Disabilities of all State programs for
18 services to persons in community care facilities for persons
19 with mental illness, including but not limited to inpatient,
20 outpatient, community, and office settings, as well as
21 intermediate care facilities, that are supported by State funds
22 or by funding under Title XIX of the federal Social Security
23 Act. The Department shall report to the Senate Health and Human
24 Services Committee and the House Special Committee on

1 Fee-for-Service Initiatives, or their successor committees, on
2 the development of the integrated system provided under this
3 Section no later than January 1, 2006 and annually thereafter.
4 The Department shall form a medical advisory panel, appointed
5 by the Secretary, comprised of 5 physicians licensed to
6 practice medicine in all its branches with a special emphasis
7 in treating mental illness, to provide advice on care rendered
8 to patients in any recovery oriented, integrated delivery
9 system. The Department of Human Services shall succeed to the
10 responsibilities of the Department of Mental Health and
11 Developmental Disabilities and the Department of
12 Rehabilitation Services under any such cooperative arrangement
13 in existence on July 1, 1997.

15     Section 10. The Community Services Act is amended by
16 changing Section 1 as follows:
 
17     (405 ILCS 30/1)  (from Ch. 91 1/2, par. 901)
18     Sec. 1. Purpose. It is declared to be the policy and intent
19 of the Illinois General Assembly that the Department of Human
20 Services assume leadership in facilitating the establishment
21 of comprehensive and coordinated arrays of private and public
22 services for persons with mental illness, persons with a
23 developmental disability, and alcohol and drug dependent
24 citizens residing in communities throughout the state. The
25 Department shall work in partnership with local government
26 entities, direct service providers, voluntary associations and
27 communities to create a system that is sensitive to the needs
28 of local communities and which complements existing family and
29 other natural supports, social institutions and programs.
30     The goals of the service system shall include but not be
31 limited to the following: to strengthen the disabled
32 individual's independence, self-esteem and ability to

1 participate in and contribute to community life; to provide
2 recovery oriented services directed toward achieving and
3 maintaining a person's full or partial recovery from the
4 symptoms of mental illness and the attainment of economic
5 self-sufficiency and community integration; to insure
6 continuity of care for clients; to enable disabled persons to
7 access needed services, commensurate with their individual
8 wishes and needs, regardless of where they reside in the state;
9 to prevent unnecessary institutionalization and the
10 dislocation of individuals from their home communities; to
11 provide a range of services so that persons can receive these
12 services in settings which do not unnecessarily restrict their
13 liberty; and to encourage clients to move among settings as
14 their needs change.
15     The system shall include provision of services in the areas
16 of prevention, client assessment and diagnosis, case
17 coordination, crisis and emergency care, treatment and
18 habilitation and support services, and community residential
19 alternatives to institutional settings. The General Assembly
20 recognizes that community programs are an integral part of the
21 larger service system, which includes state-operated
22 facilities for persons who cannot receive appropriate services
23 in the community.
24     Towards achievement of these ends, the Department of Human
25 Services, working in coordination with other State agencies,
26 shall assume responsibilities pursuant to this Act, which
27 includes activities in the areas of planning, quality
28 assurance, program evaluation, community education, and the
29 provision of financial and technical assistance to local
30 provider agencies.

32     Section 15. The Community Support Systems Act is amended by
33 changing Sections 1 and 2 as follows:

1     (405 ILCS 35/1)  (from Ch. 91 1/2, par. 1101)
2     Sec. 1. Purpose. The statewide development and
3 implementation of local community support systems, including
4 recovery oriented services, to serve the chronically mentally
5 ill with emphasis on care and treatment of extended and/or
6 repeated users of inpatient and/or other intensive mental
7 health services such as day treatment, emergency and
8 non-medical residential care shall be a priority for the
9 Department of Human Services, hereinafter referred to as the
10 Department, in community program funding. The goal of the local
11 community service system shall include but not be limited to
12 recovery. Mental health recovery oriented services shall be
13 directed toward achieving and maintaining a person's full or
14 partial recovery from the symptoms of mental illness and the
15 attainment of economic self-sufficiency and community
16 integration.
17     In order to achieve this goal, the Department shall develop
18 and facilitate, in cooperation with community agencies serving
19 the mentally ill, the implementation of appropriate plans
20 providing guidance for the Department and community agencies in
21 planning, securing, funding, client assessment, service system
22 evaluation, technical assistance, and local level development
23 of community support systems. In addition, the Department shall
24 continue funding community support system pilot projects
25 established pursuant to Section 16.2 of the Mental Health and
26 Developmental Disabilities Administrative Act for the duration
27 of the established pilot project period, and shall give
28 priority for continuing funding of such community support
29 system program components of proven effectiveness at cessation
30 of the pilot project period through the Department's regular
31 grant-in-aid and purchase care resources.

2     Sec. 2. Department responsibilities.
3     (a) The Secretary of Human Services shall designate staff
4 of the Department to coordinate the development of the
5 Department's community support system strategic plan. In
6 developing the appropriate plans the responsibilities of the
7 coordinator and any additional required staff shall include:
8         (1) the development of a statewide inventory of
9     community support system service components, including
10     recovery oriented services, currently available, including
11     those components funded or provided by other public and
12     private agencies;
13         (2) delineation of a comprehensive set of community
14     support services with adequate flexibility to accommodate
15     the needs of disparate chronically mentally ill
16     populations including the young chronically mentally ill
17     client, and local conditions in the state, which shall
18     serve as the basis of the development and enhancement of
19     community support systems, including recovery oriented
20     services, statewide;
21         (3) the development of a statewide client assessment
22     system providing descriptive data appropriate for use in
23     individual service planning, aggregate statistics
24     descriptive of client population groups which can be
25     utilized in the development of local community support
26     systems, statistics for discrimination of varying client
27     populations according to client characteristics and needs,
28     and information for statewide planning;
29         (4) a study of mechanisms currently employed in funding
30     community support system components, including recovery
31     oriented services, followed by the establishment of a
32     Department policy specifying funding mechanisms
33     appropriate for specific community support system program
34     components, including recovery oriented service or program

1     components;
2         (5) the development of program and service standards to
3     enhance accountability and evaluation of community support
4     systems, including recovery oriented services, on both a
5     system-wide and component-by-component basis;
6     (b) The coordinator and his staff shall provide technical
7 assistance and training to local community agencies involved in
8 the development and provision of community support systems;
9     (c) The coordinator and his staff shall serve as the
10 Department liaison with other public and private agencies
11 involved through funding or service provision in the
12 development and maintenance of community support systems;
13     (d) The coordinator and his staff shall coordinate internal
14 Department efforts to develop community support systems,
15 including recovery oriented services. Activities shall include
16 consultation, technical assistance, leadership in
17 implementation of the strategic plan, and administration of
18 pilot projects as established in Section 3 of this Act.

20     Section 99. Effective date. This Act takes effect July 1,
21 2005.".
