AMENDMENT TO HOUSE BILL 1452

2     AMENDMENT NO. ______. Amend House Bill 1452 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Mental Health and Developmental
5 Disabilities Administrative Act is amended by adding Section 72
6 as follows:
 
7     (20 ILCS 1705/72 new)
8     Sec. 72. Consumer Advance and Expense Reimbursement Fund.
9 The Consumer Advance and Expense Reimbursement Fund is created
10 as a special fund within the State treasury. This Fund shall be
11 used, subject to appropriation, for advancing money for, and
12 reimbursing travel expenses in connection with, consumers
13 designated by legislators or the Department to participate in
14 Department or legislative work groups, task forces, panel
15 discussions, workshops, or legislative hearings. Transfers
16 shall be made into the Fund, as necessary, upon order of the
17 Director from any applicable appropriation to the Department
18 for travel expenses. Moneys from gifts, donations,
19 appropriations, and other legal sources shall also be deposited
20 into the Fund. Income earned on moneys in the Fund and
21 repayments of advances for which expenses were not incurred
22 shall be deposited into the Fund. The Department shall, by
23 January 30, 2006, adopt rules to implement and administer the
24 Fund. These rules shall include:

1         (i) provisions that these expenses shall be incurred
2     only if and to the extent that the law, resolution,
3     executive order, or other enabling document creating the
4     task force or advisory or focus work group expressly
5     authorizes such expenses; and
6         (ii) an income means test for consumers to be eligible
7     for expense advance and reimbursement.
8 This Section (20 ILCS 1705/72) is repealed on January 1, 2009.
 
9     Section 10. The State Finance Act is amended by adding
10 Section 5.640 as follows:
 
11     (30 ILCS 105/5.640 new)
12     Sec. 5.640. The Consumer Advance and Expense Reimbursement
13 Fund.
 
14     Section 99. Effective date. This Act takes effect July 1,
15 2005.".
