AMENDMENT TO HOUSE BILL 1537

AMENDMENT NO. ______. Amend House Bill 1537 by replacing everything after the enacting clause with the following:

"Section 5. The School Code is amended by adding Section 10-20.40 as follows:

(105 ILCS 5/10-20.40 new)

Sec. 10-20.40. Access to food other than federally funded meal program food. Each school board of a school that receives federal funding under the National School Lunch and National School Breakfast programs shall restrict access to all foods not being served as part of the federally funded lunch or breakfast program, including, but not limited to, vending machine foods.

Section 90. The State Mandates Act is amended by adding Section 8.29 as follows:

(30 ILCS 805/8.29 new)

Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8 of this Act, no reimbursement by the State is required for the implementation of any mandate created by this amendatory Act of the 94th General Assembly.

Section 99. Effective date. This Act takes effect upon becoming law.".
