AMENDMENT TO HOUSE BILL 2150

2     AMENDMENT NO. ______. Amend House Bill 2150 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Marriage and Dissolution of
5 Marriage Act is amended by changing Section 505.1 as follows:
 
6     (750 ILCS 5/505.1)  (from Ch. 40, par. 505.1)
7     Sec. 505.1. (a) Whenever it is determined in a proceeding
8 to establish or enforce a child support or maintenance
9 obligation that the person owing a duty of support is
10 unemployed, the court shall, unless the court makes specific
11 findings about the person based upon clear and convincing
12 evidence and determines that the person is incapable of gainful
13 employment because of a physical or a mental condition, or a
14 combination of conditions, may order the person to seek
15 employment and report periodically to the court with a diary,
16 listing or other memorandum of his or her efforts in accordance
17 with such order. Additionally, the court may order the
18 unemployed person to report to the Department of Employment
19 Security for job search services or to make application with
20 the local Job Training Partnership Act provider or an Illinois
21 Employment and Training Center for participation in job search,
22 training, or work programs and where the duty of support is
23 owed to a child receiving child support enforcement services
24 under Article X of the Illinois Public Aid Code, as amended,

1 the court may order the unemployed person to report to the
2 Illinois Department of Healthcare and Family Services Public
3 Aid for participation in job search, training or work programs
4 established under Section 9-6 and Article IXA of that Code.
5     (b) Whenever it is determined that a person owes past-due
6 support for a child or for a child and the parent with whom the
7 child is living, and the child is receiving assistance under
8 the Illinois Public Aid Code, the court shall order at the
9 request of the Illinois Department of Healthcare and Family
10 Services Public Aid:
11         (1) that the person pay the past-due support in
12     accordance with a plan approved by the court; or
13         (2) if the person owing past-due support is unemployed,
14     is subject to such a plan, and is not incapacitated, that
15     the person participate in such job search, training, or
16     work programs established under Section 9-6 and Article IXA
17     of the Illinois Public Aid Code as the court deems
18     appropriate.
