AMENDMENT TO HOUSE BILL 2241

2     AMENDMENT NO. ______. Amend House Bill 2241, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Department of State Police Law of the Civil
6 Administrative Code of Illinois is amended by changing Sections
7 2605-5 and 2605-375 as follows:
 
8     (20 ILCS 2605/2605-5)
9     Sec. 2605-5. Definitions. In this Law:
10     "Department" means the Department of State Police.
11     "Director" means the Director of State Police.
12     "Missing endangered senior" means an individual 65 years of
13 age or older who is reported missing to a law enforcement
14 agency and is, or is believed to be:
15         (1) a temporary or permanent resident of Illinois;
16         (2) at a location that cannot be determined by an
17     individual familiar with the missing individual; and
18         (3) incapable of returning to the individual's
19     residence without assistance.

22     Sec. 2605-375. Missing persons; Law Enforcement Agencies
23 Data System (LEADS).

1     (a) To establish and maintain a statewide Law Enforcement
2 Agencies Data System (LEADS) for the purpose of providing
3 electronic access by authorized entities to criminal justice
4 data repositories and effecting an immediate law enforcement
5 response to reports of missing persons, including lost, missing
6 or runaway minors and missing endangered seniors. The
7 Department shall implement an automatic data exchange system to
8 compile, to maintain, and to make available to other law
9 enforcement agencies for immediate dissemination data that can
10 assist appropriate agencies in recovering missing persons and
11 provide access by authorized entities to various data
12 repositories available through LEADS for criminal justice and
13 related purposes. To assist the Department in this effort,
14 funds may be appropriated from the LEADS Maintenance Fund.
15     (b) In exercising its duties under this Section, the
16 Department shall do the following:
17         (1) Provide a uniform reporting format for the entry of
18     pertinent information regarding the report of a missing
19     person into LEADS. The report must include all of the
20     following:
21             (A) Relevant information obtained from the
22         notification concerning the missing person, including
23         all of the following:
24                 (i) a physical description of the missing
25             person;
26                 (ii) the date, time, and place that the missing
27             person was last seen; and
28                 (iii) the missing person's address.
29             (B) Information gathered by a preliminary
30         investigation, if one was made.
31             (C) A statement by the law enforcement officer in
32         charge stating the officer's assessment of the case
33         based on the evidence and information received.
34         The Department of State Police shall prepare the report

1     required by this paragraph (1) as soon as practical, but
2     not later than 5 hours after the Department receives
3     notification of a missing person.
4         (2) Develop and implement a policy whereby a statewide
5     or regional alert would be used in situations relating to
6     the disappearances of individuals, based on criteria and in
7     a format established by the Department. Such a format shall
8     include, but not be limited to, the age of the missing
9     person and the suspected circumstance of the
10     disappearance.
11         (3) Notify all law enforcement agencies that reports of
12     missing persons shall be entered as soon as the minimum
13     level of data specified by the Department is available to
14     the reporting agency and that no waiting period for the
15     entry of the data exists.
16         (4) Compile and retain information regarding lost,
17     abducted, missing, or runaway minors in a separate data
18     file, in a manner that allows that information to be used
19     by law enforcement and other agencies deemed appropriate by
20     the Director, for investigative purposes. The information
21     shall include the disposition of all reported lost,
22     abducted, missing, or runaway minor cases.
23         (5) Compile and maintain an historic data repository
24     relating to lost, abducted, missing, or runaway minors and
25     other missing persons, including, but not limited to,
26     missing endangered seniors, in order to develop and improve
27     techniques utilized by law enforcement agencies when
28     responding to reports of missing persons.
29         (6) Create a quality control program regarding
30     confirmation of missing person data, timeliness of entries
31     of missing person reports into LEADS, and performance
32     audits of all entering agencies.
33         (7) Upon completion of the report required by paragraph
34     (1), the Department of State Police shall immediately

1     forward the contents of the report to all of the following:
2             (A) all law enforcement agencies that have
3         jurisdiction in the location where the missing person
4         lives and all law enforcement agencies that have
5         jurisdiction in the location where the missing person
6         was last seen;
7             (B) all law enforcement agencies to which the
8         person who made the notification concerning the
9         missing person requests the report be sent, if the
10         Department determines that the request is reasonable
11         in light of the information received;
12             (C) all law enforcement agencies that request a
13         copy of the report; and
14             (D) the National Crime Information Center's
15         Missing Person File, if appropriate.
16         (8) The Department of State Police shall begin an
17     investigation concerning the missing person not later than
18     24 hours after receiving notification of a missing person.
19     (c) The Illinois Law Enforcement Training Standards Board
20 shall conduct a training program for law enforcement personnel
21 of local governmental agencies in the statewide coordinated
22 missing endangered senior alert system established under this
23 Section.

27     Section 10. The Illinois Police Training Act is amended by
28 changing Section 10.10 as follows:
 
29     (50 ILCS 705/10.10)
30     Sec. 10.10. Training in child abduction and missing
31 endangered senior alert system. The Board shall conduct a
32 training program for law enforcement personnel of local

1 governmental agencies in the statewide coordinated child
2 abduction alert system developed under Section 2605-480 of the
3 Department of State Police Law of the Civil Administrative Code
4 of Illinois and the statewide coordinated missing endangered
5 senior alert system developed under Section 2605-375 of the
6 Department of State Police Law of the Civil Administrative Code
7 of Illinois.

9     Section 99. Effective date. This Act takes effect January
