SYNOPSIS AS INTRODUCED:

625 ILCS 5/18c-7402.2 new

Amends the Illinois Vehicle Code. Provides that it is unlawful for a railroad or any of its employees to interfere in any way with a railroad employee's effort to obtain first aid or medical treatment for an injury suffered in the course of employment. Provides that it is unlawful for a railroad or any of its employees to discipline or threaten to discipline an employee for requesting treatment for a job-related injury. Provides that a violation is a business offense punishable by a fine of not more than $10,000.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 18c-7402.2 as follows:

(625 ILCS 5/18c-7402.2 new)

Sec. 18c-7402.2. Employee first aid or medical treatment; interference prohibited.

(a) It is unlawful for a railroad or person employed by a railroad to:

(1) deny, delay, or interfere with medical treatment or first aid treatment to an employee of a railroad who has been injured during employment; or

(2) discipline or threaten discipline to an employee of a railroad who has been injured during employment for requesting medical treatment or first aid treatment.

(b) A violation of this Section is a business offense and is punishable by a fine of not more than $10,000 for each violation.
