Amends the Community Services Act. Provides that a goal of the community services system is to provide recovery oriented services directed toward achieving and maintaining a person's full or partial recovery from the symptoms of mental illness and the attainment of economic self-sufficiency and community integration. Amends the Community Support Systems Act. Provides that local community support system service components include recovery oriented components. Provides that the goal of the local community service system shall include but not be limited to recovery. Provides that mental health recovery oriented services shall be directed toward achieving and maintaining a person's full or partial recovery from the symptoms of mental illness and the attainment of economic self-sufficiency and community integration. Effective July 1, 2005.

| AN ACT concerning health.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Community Services Act is amended by | 5 |
| changing Section 1 as follows:
| 6 |
| (405 ILCS 30/1) (from Ch. 91 1/2, par. 901)
| 7 |
| Sec. 1. Purpose. It is declared to be the policy and intent | 8 |
| of the Illinois
General Assembly that the Department of Human | 9 |
| Services assume leadership in
facilitating the establishment | 10 |
| of
comprehensive
and coordinated arrays of private and public | 11 |
| services for persons with mental
illness, persons with a | 12 |
| developmental disability, and alcohol and drug
dependent | 13 |
| citizens residing in communities throughout the state. The
| 14 |
| Department shall work
in partnership with local government | 15 |
| entities, direct service providers,
voluntary
associations and | 16 |
| communities to create a system that is sensitive to the needs
| 17 |
| of local communities and which complements existing family and | 18 |
| other natural
supports, social institutions and programs.
| 19 |
| The goals of the service system shall include but not be | 20 |
| limited to the
following: to strengthen the disabled | 21 |
| individual's independence, self-esteem
and ability to | 22 |
| participate in and contribute to community life; to provide | 23 |
| recovery oriented services directed toward achieving and | 24 |
| maintaining a person's full or partial recovery from the | 25 |
| symptoms of mental illness and the attainment of economic | 26 |
| self-sufficiency and community integration; to insure
| 27 |
| continuity of care for clients; to enable disabled persons to | 28 |
| access needed
services, commensurate with their individual | 29 |
| wishes and needs, regardless
of where they reside in the state; | 30 |
| to prevent unnecessary institutionalization
and the | 31 |
| dislocation of individuals from their home communities; to | 32 |
| provide
a range of services so that persons can receive these |

| services in settings
which do not unnecessarily restrict their | 2 |
| liberty; and to encourage clients
to move among settings as | 3 |
| their needs change.
| 4 |
| The system shall include provision of services in the areas | 5 |
| of prevention,
client assessment and diagnosis, case | 6 |
| coordination, crisis and emergency
care, treatment and | 7 |
| habilitation and support services, and community
residential | 8 |
| alternatives to institutional settings. The General Assembly
| 9 |
| recognizes that community programs are an integral part of the | 10 |
| larger service
system, which includes state-operated | 11 |
| facilities for persons who cannot receive
appropriate services | 12 |
| in the community.
| 13 |
| Towards achievement of these ends, the Department of Human | 14 |
| Services, working
in coordination with other State agencies, | 15 |
| shall assume responsibilities
pursuant to this Act, which | 16 |
| includes activities in the areas of planning,
quality | 17 |
| assurance, program evaluation, community education, and the | 18 |
| provision
of financial and technical assistance to local | 19 |
| provider agencies.

| Section 10. The Community Support Systems Act is amended by | 22 |
| changing Sections 1 and 2 as follows:
| 23 |
| (405 ILCS 35/1) (from Ch. 91 1/2, par. 1101)
| 24 |
| Sec. 1. Purpose. The statewide development and | 25 |
| implementation of local
community support systems , including | 26 |
| recovery oriented services, to serve the chronically mentally | 27 |
| ill with emphasis
on care and treatment of extended and/or | 28 |
| repeated users of inpatient and/or
other intensive mental | 29 |
| health services such as day treatment, emergency
and | 30 |
| non-medical residential care shall be a priority for the | 31 |
| Department of
Human Services, hereinafter referred to as the | 32 |
| Department, in community program
funding. The goal of the local | 33 |
| community service system shall include but not be limited to | 34 |
| recovery. Mental health recovery oriented services shall be |

| directed toward achieving and maintaining a person's full or | 2 |
| partial recovery from the symptoms of mental illness and the | 3 |
| attainment of economic self-sufficiency and community | 4 |
| integration.
| 5 |
| In order to achieve this goal, the Department shall develop | 6 |
| and
facilitate, in cooperation with community agencies serving | 7 |
| the mentally
ill, the implementation of appropriate plans | 8 |
| providing guidance for the
Department and community agencies
in | 9 |
| planning, securing, funding, client assessment, service system | 10 |
| evaluation,
technical assistance, and local level development | 11 |
| of community support
systems. In addition, the Department shall | 12 |
| continue funding community support
system pilot projects | 13 |
| established pursuant to Section 16.2 of the Mental Health
and
| 14 |
| Developmental Disabilities Administrative Act for the duration | 15 |
| of the
established pilot project period, and shall give | 16 |
| priority for continuing
funding of such community support | 17 |
| system program components of proven
effectiveness
at cessation | 18 |
| of the pilot project period through the Department's regular
| 19 |
| grant-in-aid and purchase care resources.

| 22 |
| Sec. 2. Department responsibilities.
| 23 |
| (a) The Secretary of Human Services shall designate
staff | 24 |
| of the Department to coordinate the development of the | 25 |
| Department's
community support system strategic plan. In | 26 |
| developing
the appropriate plans the responsibilities of the | 27 |
| coordinator and any
additional required staff shall include:
| 28 |
| (1) the development of a statewide inventory of | 29 |
| community support system
service components , including | 30 |
| recovery oriented services, currently available, including | 31 |
| those components funded
or provided by other public and | 32 |
| private agencies;
| 33 |
| (2) delineation of a comprehensive set of community | 34 |
| support services with
adequate flexibility to accommodate | 35 |
| the needs of disparate chronically mentally
ill |

| populations including the young chronically mentally ill | 2 |
| client, and
local conditions in the state, which shall | 3 |
| serve as the basis of the
development
and enhancement of | 4 |
| community support systems , including recovery oriented | 5 |
| services, statewide;
| 6 |
| (3) the development of a statewide client assessment | 7 |
| system providing
descriptive data appropriate for use in | 8 |
| individual service planning, aggregate
statistics | 9 |
| descriptive of client population groups which can be | 10 |
| utilized
in the development of local community support | 11 |
| systems, statistics for
discrimination
of varying client | 12 |
| populations according to client characteristics and needs,
| 13 |
| and information for statewide planning;
| 14 |
| (4) a study of mechanisms currently employed in funding | 15 |
| community support
system components, including recovery | 16 |
| oriented services, followed by the establishment of a | 17 |
| Department policy
specifying funding mechanisms | 18 |
| appropriate for specific community support
system program | 19 |
| components , including recovery oriented service or program | 20 |
| components ;
| 21 |
| (5) the development of program and service standards to | 22 |
| enhance accountability and
evaluation of community support | 23 |
| systems , including recovery oriented services, on both a | 24 |
| system-wide and
component-by-component
basis;
| 25 |
| (b) The coordinator and his staff shall provide technical | 26 |
| assistance and
training to local community agencies involved in | 27 |
| the development and provision
of community support systems;
| 28 |
| (c) The coordinator and his staff shall serve as the | 29 |
| Department liaison
with other public and private agencies | 30 |
| involved through funding or service
provision in the | 31 |
| development and maintenance of community support systems;
| 32 |
| (d) The coordinator and his staff shall coordinate internal | 33 |
| Department
efforts to develop community support systems , | 34 |
| including recovery oriented services . Activities shall include | 35 |
| consultation,
technical assistance, leadership in | 36 |
| implementation of the strategic plan,
and administration of |

| pilot projects as established in Section 3 of this Act.

| Section 99. Effective date. This Act takes effect July 1, | 4 |
| 2005.

|
