SYNOPSIS AS INTRODUCED:
 
70 ILCS 705/16d new

    Amends the Fire Protection District Act. Allows 2 fire protection districts by ordinance to disconnect and annex a territory of up to 60 acres when the annexing district can provide better fire protection. Requires that the district disconnecting the area must notify the owners of the land that is to be disconnected. Provides that the notice shall be given 30 days before adoption of an ordinance by either of the districts. The notice shall include a map of the territory and describe the area to be disconnected, the annexing fire district, and the reasons for taking the action.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Fire Protection District Act is amended by
5 adding Section 16d as follows:
 
6     (70 ILCS 705/16d new)
7     Sec. 16d. When a fire protection district has another fire
8 protection district adjoining it and the adjoining district can
9 provide better fire protection to an area of land of no more
10 than 60 acres, consisting of one or more tracts, that is within
11 the corporate limits of the fire protection district, the area
12 may be disconnected from the district and annexed to the
13 adjacent district when each district adopts an ordinance to
14 accomplish the disconnection and annexation. The disconnecting
15 district shall give 30 days' notice to the owner or owners of
16 record of the area of land stating that the disconnecting and
17 annexing districts intend to adopt ordinances that would
18 disconnect and annex the area under this Section. The notice
19 shall name the annexing district and include a description of
20 the territory to be disconnected and annexed, the reason for
21 doing so, and a map of the territory. The notice shall be sent
22 by certified mail return receipt requested, but if the name or
23 address of an owner is not known, then the district must
24 publish the notice once a week for 2 successive weeks. The
25 notice shall be published in a newspaper published in the
26 county where the area is located. Each district's ordinance
27 shall designate the same date for the effective date of the
28 disconnection and annexation. Thirty days after the delivery of
29 the notice to the last of the owners involved or 30 days after
30 the date of the first publication of the notice, whichever is
31 later, the disconnecting and annexing districts may adopt an
32 ordinance accomplishing the disconnection and annexation.

1 After it adopts the ordinance, each fire protection district
2 shall send a certified copy of the ordinance to the proper
3 county clerk or clerks for filing and to the office of the
4 State Fire Marshal.
