SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/18c-1801.1 new
625 ILCS 5/18c-1802   from Ch. 95 1/2, par. 18c-1802

    Amends the Illinois Commercial Transportation Law in the Illinois Vehicle Code. Provides that documents, records, or other writings that may be filed with the Illinois Commerce Commission may be filed electronically under rules to be adopted by the Commission. Provides that the new rules must comply with Article 25 of the Electronic Commerce Security Act. Provides that any correspondence from the Commission is considered to have been served at the time it is sent by electronic means. Provides that the Commission may use an electronic date-and-time stamp for accepting electronic filings.

1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 18c-1802 and by adding Section 18c-1801.1 as follows:
 
6     (625 ILCS 5/18c-1801.1 new)
7     Sec. 18c-1801.1. Electronic filings; administrative rules.
8     (1) Whenever a document, record, or other writing is
9 required or permitted by statute or by rule of the Commission
10 to be provided to the Commission, the writing may be provided
11 to the Commission in electronic form according to rules adopted
12 by the Commission. Whenever a writing is required or to be
13 provided by the Commission or by any person or party to any
14 person or party other than the Commission, the writing may be
15 provided in electronic form according to rules adopted by the
16 Commission. Rules adopted under this Section must comply with
17 the requirements of Article 25 of the Electronic Commerce
18 Security Act.
19     (2) The Commission is authorized to adopt by rule, and to
20 impose and collect, reasonable fees to offset the cost of
21 developing, deploying, and enhancing automated systems for
22 transactions according to the rules adopted under this Section
23 or under other rules adopted by the Commission.
24     (3) The Commission is authorized to adopt by rule, and to
25 impose and collect, reasonable administrative fees to offset
26 all costs necessary to accept, process, store, and otherwise
27 administer systems for documents, records, and other writings
28 that are not electronic, once the rules permitted by this
29 Section have been adopted.

31     Sec. 18c-1802. Time of Service. Notices, orders, process

1 and other correspondence of the Commission shall be deemed
2 served at the time they are deposited in the United States mail
3 or delivered to a commercial delivery service or delivered in
4 person by an employee or agent of the Commission or sent by
5 electronic means. Notices, orders, process and other
6 correspondence shall be deemed served on the Commission at the
7 time of receipt. The Commission may use an electronic
8 date-and-time stamp, derived from a trusted time source, for
9 accepting electronic filings.

11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
