1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Veterans Affairs Act is
5 amended by changing Section 2.01 as follows:
 
6     (20 ILCS 2805/2.01)  (from Ch. 126 1/2, par. 67.01)
7     Sec. 2.01. Veterans Home admissions.
8     (a) Any honorably discharged veteran is entitled to
9 admission to an Illinois Veterans Home, if the applicant meets
10 the requirements of this Section. :
11     (b) (a) The Veteran must:
12      (1) have Has served in the armed forces of the United
13     States at least 1 day in the Spanish American War, World
14     War I, World War II, the Korean Conflict, the Viet Nam
15     Campaign, or the Persian Gulf Conflict between the dates
16     recognized by the U.S. Department of Veterans Affairs or
17     between any other present or future dates recognized by the
18     U.S. Department of Veterans Affairs as a war period, or
19     have has served in a hostile fire environment and has been
20     awarded a campaign or expeditionary medal signifying his or
21     her service, for purposes of eligibility for domiciliary or
22     nursing home care; or
23         (2) have served and been honorably discharged or
24     retired from the armed forces of the United States for a
25     service connected disability or injury, for purposes of
26     eligibility for domiciliary or nursing home care;
27         (3) have served as an enlisted person at least 90 days
28     on active duty in the armed forces of the United States,
29     excluding service on active duty for training purposes
30     only, and entered active duty before September 8, 1980, for
31     purposes of eligibility for domiciliary or nursing home
32     care;

1         (4) have served as an officer at least 90 days on
2     active duty in the armed forces of the United States,
3     excluding service on active duty for training purposes
4     only, and entered active duty before October 17, 1981, for
5     purposes of eligibility for domiciliary or nursing home
6     care;
7         (5) have served on active duty in the armed forces of
8     the United States for 24 months of continuous service or
9     more, excluding active duty for training purposes only, and
10     enlisted after September 7, 1980, for purposes of
11     eligibility for domiciliary or nursing home care;
12         (6) have served as a reservist in the armed forces of
13     the United States or the National Guard and the service
14     included being called to federal active duty, excluding
15     service on active duty for training purposes only, and who
16     completed the term, for purposes of eligibility for
17     domiciliary or nursing home care;
18         (7) have been discharged for reasons of hardship or
19     released from active duty due to a reduction in the United
20     States armed forces prior to the completion of the required
21     period of service, regardless of the actual time served,
22     for purposes of eligibility for domiciliary or nursing home
23     care; or
24         (8) have (2) Has (i) served on active duty in the armed
25     forces for one year for purposes of eligibility for
26     domiciliary care only or (ii) served in the National Guard
27     or Reserve Forces of the United States and completed 20
28     years of satisfactory service, be is otherwise eligible to
29     receive reserve or active duty retirement benefits, and
30     have has been an Illinois resident for at least one year
31     before applying for admission for purposes of eligibility
32     for domiciliary care only. ; and
33     (c) The veteran must have (b) Has service accredited to the
34 State of Illinois or have has been a resident of this State for
35 one year immediately preceding the date of application. ; and
36     (d) (c) For admission to the Illinois Veterans Homes at

1 Anna and Quincy, the veteran must be is disabled by disease,
2 wounds, or otherwise and because of the disability be is
3 incapable of earning a living. ; or
4     (e) (d) For admission to the Illinois Veterans Homes at
5 LaSalle and Manteno and for admission to the John Joseph Kelly
6 Veteran's Home, the veteran must be is disabled by disease,
7 wounds, or otherwise and, for purposes of eligibility for
8 nursing home care, require requires nursing care because of the
9 disability.
10     (f) An individual who served during a time of conflict as
11 set forth in subsection (a)(1) of this Section has preference
12 over all other qualifying candidates, for purposes of
13 eligibility for domiciliary or nursing home care at any
14 Illinois Veterans Home.

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
