AMENDMENT TO HOUSE BILL 4363

2     AMENDMENT NO. ______. Amend House Bill 4363 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.7 as follows:
 
6     (20 ILCS 1605/2)  (from Ch. 120, par. 1152)
7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 the State's Common School Fund, except as provided in Sections
11 21.2, and 21.5, and 21.6 , and 21.7.

15     Sec. 20. State Lottery Fund.
16     (a) There is created in the State Treasury a special fund
17 to be known as the "State Lottery Fund". Such fund shall
18 consist of all revenues received from (1) the sale of lottery
19 tickets or shares, (net of commissions, fees representing those
20 expenses that are directly proportionate to the sale of tickets
21 or shares at the agent location, and prizes of less than $600
22 which have been validly paid at the agent level), (2)
23 application fees, and (3) all other sources including moneys

1 credited or transferred thereto from any other fund or source
2 pursuant to law. Interest earnings of the State Lottery Fund
3 shall be credited to the Common School Fund.
4     (b) The receipt and distribution of moneys under Section
5 21.5 of this Act shall be in accordance with Section 21.5.
6     (c) (b) The receipt and distribution of moneys under
7 Section 21.6 of this Act shall be in accordance with Section
8 21.6.
9     (d) The receipt and distribution of moneys under Section
10 21.7 of this Act shall be in accordance with Section 21.7.

13     (20 ILCS 1605/21.7 new)
14     Sec. 21.7. Wild about animals scratch-off game.
15     (a) The Department shall offer a special instant
16 scratch-off game for the benefit of threatened or endangered
17 species, humane education programs, and dogs and cats. The game
18 shall commence on January 1, 2007 or as soon thereafter, in the
19 discretion of the Director, as is reasonably practical. The
20 operation of the game shall be governed by this Act and any
21 rules adopted by the Department. If any provision of this
22 Section is inconsistent with any other provision of this Act,
23 then this Section governs.
24     (b) The Endangered Species Rehabilitation Fund is created
25 as a special fund in the State treasury. The net revenue from
26 the wild about animals scratch-off game created under this
27 Section shall be deposited into the Fund for appropriation by
28 the General Assembly as follows:
29         (1) One-third of net revenue to the Department of
30     Natural Resources for making grants for the maintenance of
31     wildlife rehabilitation facilities that take care of
32     threatened or endangered species.
33         (2) One-third of net revenue to the State Board of

1     Education for character and humane education programs; and
2         (3) One-third of net revenue into the Pet Population
3     Control Fund.
4     Moneys received for the purposes of this Section,
5 including, without limitation, net revenue from the special
6 instant scratch-off game and from gifts, grants, and awards
7 from any public or private entity, must be deposited into the
8 Fund. Any interest earned on moneys in the Fund must be
9 deposited into the Fund. For purposes of this subsection, "net
10 revenue" means the total amount for which tickets have been
11 sold less the sum of the amount paid out in the prizes and the
12 actual administrative expenses of the Department solely
13 related to the scratch-off game under this Section.
14     (c) During the time that tickets are sold for the wild
15 about animals scratch-off game, the Department shall not
16 unreasonably diminish the efforts devoted to marketing any
17 other instant scratch-off lottery game.
18     (d) The Department may adopt any rules necessary to
19 implement and administer the provisions of this Section.
 
20     Section 10. The State Finance Act is amended by adding
21 Section 5.663 as follows:

23     Sec. 5.663. The Endangered Species Rehabilitation Fund.
 
24     Section 99. Effective date. This Act takes effect upon
25 becoming law.".
