AMENDMENT TO HOUSE BILL 4977

2     AMENDMENT NO. ______. Amend House Bill 4977, on page 1,
3 line 4, after "amended", by inserting "by changing Section
4 8-405 and"; and
 
5 on page 1, immediately below line 5, by inserting the
6 following:
 
7     "(220 ILCS 5/8-405)  (from Ch. 111 2/3, par. 8-405)
8     Sec. 8-405. Strategic options for changing the structure of
9 energy services markets. The Commission is authorized, to the
10 extent consistent with its energy supply planning
11 responsibilities and the energy supply planning objectives of
12 this Act, to study strategic options for changing the structure
13 of energy services markets when (a) such study is authorized by
14 a vote of the full Commission; (b) the study findings are
15 subject to full public hearings and opportunity for comment;
16 and (c) the study findings and any findings from public
17 hearings are fully reported to the General Assembly together
18 with any recommendations adopted by a vote of the Commission
19 concerning the need for legislative action.
20     Notwithstanding any provision to the contrary the
21 Commission shall not require or implement any system or means
22 for the dispatch or brokering of power from a central location
23 unless and until such action is recommended, after notice and
24 hearing, by a majority vote of the entire Commission and

1 expressly authorized by the General Assembly upon
2 consideration of the Commission recommendation.

4 on page 4, immediately below line 3, by inserting the
5 following:
 
6     "(220 ILCS 5/4-305 rep.)
7     (220 ILCS 5/9-216 rep.)
8     Section 10. The Public Utilities Act is amended by
9 repealing Sections 4-305 and 9-216.".
