AMENDMENT TO HOUSE BILL 5547

2     AMENDMENT NO. ______. Amend House Bill 5547 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Childhood Hunger Relief Act is amended by
5 changing Section 20 as follows:
 
6     (105 ILCS 126/20)
7     Sec. 20. Summer food service program.
8     (a) The State Board of Education shall promulgate a State
9 plan for summer food service programs, in accordance with 42
10 U.S.C. Sec. 1761 and any other applicable federal laws and
11 regulations, by January 15, 2006.
12     (b) On or before April 15, 2007, a school district must
13 promulgate a plan to have a summer food service program for
14 each school in which at least 50% of the students are eligible
15 for free or reduced-price school meals. The plan must be
16 implemented during the summer of 2007. If the school district
17 has one or more elementary schools that qualify, the summer
18 food service program must be operated within 5 miles of at
19 least one of the elementary schools and within 10 miles of the
20 other elementary schools, if any. If a school is not open
21 during the summer months, the school district may identify a
22 not-for-profit entity that is willing to sponsor a summer food
23 service program serving school-aged children in the
24 surrounding school area and may provide assistance to the

1 entity in documenting the number of children in the area who
2 are eligible for free or reduced-price school meals. By the
3 summer of 2006 and then each summer thereafter, it is strongly
4 encouraged that the board of education of each school district
5 in this State in which at least 50% of the students are
6 eligible for free or reduced-price school meals operate a
7 summer food service program or identify a non-profit or private
8 agency to sponsor a summer food service program within the
9 school district's boundaries.
10     (c) Summer food service programs established under this
11 Section shall may be supported by federal funds and commodities
12 and other available State and local resources.
