SYNOPSIS AS INTRODUCED:
 
ILCON Art. IX, Sec. 11 new

    Proposes to amend the Revenue Article of the Illinois Constitution. Specifies the State and local highway purposes for which moneys derived from motor vehicle and motor vehicle fuels fees, excises, and license taxes may be used. Limits each fiscal year's total appropriations for State traffic law enforcement, administration of motor vehicle laws, and administration and collection of motor vehicle and motor vehicle fuel fees, excises, and license taxes to 5% of the amount of those fees, excises, and taxes collected in the previous fiscal year. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to add Section 11 to Article IX
9 of the Illinois Constitution as follows:

REVENUE

12     (ILCON Art. IX, Sec. 11 new)
13 SECTION 11. HIGHWAY FUNDS
14     (a) No moneys derived from fees, excises, or license taxes
15 relating to registration, titles, operation, or use of vehicles
16 on public highways or relating to fuels used for propelling
17 those vehicles, including bond proceeds, shall be expended for
18 other than (i) costs of administering those laws; (ii)
19 statutory refunds and adjustments provided in those laws; (iii)
20 payment of highway obligations; (iv) costs for construction,
21 reconstruction, maintenance, repair, and betterment of public
22 highways, roads, streets, and bridges and other statutory
23 highway purposes; (v) the State or local share to match federal
24 aid highway funds; (vi) administrative costs of the Department
25 of Transportation or any successor agency; (vii) expenses of
26 grade separation of public highways and railroad crossings;
27 (viii) protection of at-grade public highways and railroad
28 crossings; (ix) expense of State enforcement of traffic laws;
29 and (x) with respect to local governments, other transportation
30 purposes as authorized by law.
31     (b) The total amount appropriated in any fiscal year for
32 the sum of the cost of State enforcement of traffic laws plus
33 the cost of collecting and administering fees, excises, and

1 license taxes described in subsection (a) plus the cost of
2 administering laws relating to motor vehicles shall not exceed
3 5% of the total amount of those fees, excises, and taxes
4 collected by the State of Illinois in the most recent complete
5 fiscal year.
6     (c) Federal funds may be spent for any purposes authorized
7 by federal law.

SCHEDULE
9     This Constitutional Amendment takes effect upon being
10 declared adopted in accordance with Section 7 of the Illinois
11 Constitutional Amendment Act.
