    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois and the State Finance Act. Creates the Vince Demuzio Memorial Colon Cancer Research Fund and provides that, from appropriations from the Fund, the Department of Public Health must make grants to public or private entities in Illinois for the purpose of funding research applicable to colon cancer patients. Amends the Illinois Income Tax Act to create a tax checkoff for the Fund.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 2310-399 as follows:
 
7     (20 ILCS 2310/2310-399 new)
8     Sec. 2310-399. The Vince Demuzio Memorial Colon Cancer
9 Research Fund; grants. The Vince Demuzio Memorial Colon Cancer
10 Research Fund is created as a special fund in the State
11 treasury. From appropriations to the Department from the Fund,
12 the Department must make grants to public or private entities
13 in Illinois for the purpose of funding research applicable to
14 colon cancer patients. For purposes of this Section, the term
15 "research" includes, without limitation, expenditures to
16 develop and advance the understanding, techniques, and
17 modalities effective in the detection, prevention, cure,
18 screening, and treatment of colon cancer and may include
19 clinical trials. The grant funds may not be used for
20 institutional overhead costs, indirect costs, other
21 organizational levies, or costs of community-based support
22 services.
23     Moneys received for the purposes of this Section,
24 including, without limitation, income tax checkoff receipts
25 and gifts, grants, and awards from any public or private
26 entity, must be deposited into the Fund. Any interest earned on
27 moneys in the Fund must be deposited into the Fund.
 
28     Section 10. The State Finance Act is amended by adding
29 Section 5.625 as follows:

1     Sec. 5.625. The Vince Demuzio Memorial Colon Cancer
2 Research Fund.
 
3     Section 15. The Illinois Income Tax Act is amended by
4 changing Sections 509 and 510 and by adding Section 507EE as
5 follows:

7     Sec. 507EE. The Vince Demuzio Memorial Colon Cancer
8 Research Fund checkoff. For taxable years ending on or after
9 December 31, 2005, the Department must print on its standard
10 individual income tax form a provision indicating that if the
11 taxpayer wishes to contribute to the Vince Demuzio Memorial
12 Colon Cancer Research Fund, as authorized by this amendatory
13 Act of the 94th General Assembly, he or she may do so by
14 stating the amount of the contribution (not less than $1) on
15 the return and that the contribution will reduce the taxpayer's
16 refund or increase the amount of payment to accompany the
17 return. Failure to remit any amount of increased payment shall
18 reduce the contribution accordingly. This Section does not
19 apply to any amended return.

21     Sec. 509. Tax checkoff explanations. All individual income
22 tax return forms shall contain appropriate explanations and
23 spaces to enable the taxpayers to designate contributions to
24 the following funds: the Child Abuse Prevention Fund, the
25 Illinois Wildlife Preservation Fund (as required by the
26 Illinois Non-Game Wildlife Protection Act), the Alzheimer's
27 Disease Research Fund (as required by the Alzheimer's Disease
28 Research Act), the Assistance to the Homeless Fund (as required
29 by this Act), the Penny Severns Breast and Cervical Cancer
30 Research Fund, the National World War II Memorial Fund, the
31 Prostate Cancer Research Fund, the Lou Gehrig's Disease (ALS)
32 Research Fund, the Multiple Sclerosis Assistance Fund, the
33 Leukemia Treatment and Education Fund, the World War II

1 Illinois Veterans Memorial Fund, the Korean War Veterans
2 National Museum and Library Fund, the Illinois Military Family
3 Relief Fund, the Illinois Veterans' Homes Fund, the Vince
4 Demuzio Memorial Colon Cancer Research Fund, and the Asthma and
5 Lung Research Fund.
6     Each form shall contain a statement that the contributions
7 will reduce the taxpayer's refund or increase the amount of
8 payment to accompany the return. Failure to remit any amount of
9 increased payment shall reduce the contribution accordingly.
10     If, on October 1 of any year, the total contributions to
11 any one of the funds made under this Section do not equal
12 $100,000 or more, the explanations and spaces for designating
13 contributions to the fund shall be removed from the individual
14 income tax return forms for the following and all subsequent
15 years and all subsequent contributions to the fund shall be
16 refunded to the taxpayer.

22     Sec. 510. Determination of amounts contributed. The
23 Department shall determine the total amount contributed to each
24 of the following: the Child Abuse Prevention Fund, the Illinois
25 Wildlife Preservation Fund, the Assistance to the Homeless
26 Fund, the Alzheimer's Disease Research Fund, the Penny Severns
27 Breast and Cervical Cancer Research Fund, the National World
28 War II Memorial Fund, the Prostate Cancer Research Fund, the
29 Illinois Military Family Relief Fund, the Lou Gehrig's Disease
30 (ALS) Research Fund, the Multiple Sclerosis Assistance Fund,
31 the Leukemia Treatment and Education Fund, the World War II
32 Illinois Veterans Memorial Fund, the Korean War Veterans
33 National Museum and Library Fund, the Illinois Veterans' Homes
34 Fund, the Vince Demuzio Memorial Colon Cancer Research Fund,
35 and the Asthma and Lung Research Fund; and shall notify the

1 State Comptroller and the State Treasurer of the amounts to be
2 transferred from the General Revenue Fund to each fund, and
3 upon receipt of such notification the State Treasurer and
4 Comptroller shall transfer the amounts.
