AMENDMENT TO SENATE BILL 250

2     AMENDMENT NO. ______. Amend Senate Bill 250 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Capital Development Board Act is amended by
5 changing Sections 3 and 10.04 as follows:
 
6     (20 ILCS 3105/3)  (from Ch. 127, par. 773)
7     Sec. 3. As used in this Act, unless the context otherwise
8 requires:
9     "Board" means the Capital Development Board.
10     "State agency" means and includes each officer,
11 department, board, commission, institution, body politic and
12 corporate of the State including the Illinois Building
13 Authority, school districts, and any other person expending or
14 encumbering State or federal funds by virtue of an
15 appropriation or other authorization by the General Assembly or
16 federal authorization or grant. Except as otherwise expressly
17 authorized by the General Assembly, the term does not include
18 the Department of Transportation, the Department of Natural
19 Resources, or Environmental Protection Agency, except as
20 respects buildings used by the Department or Agency for its
21 officers, employees, or equipment, or any of them, and for
22 capital improvements related to such buildings. Nor does the
23 term include the Illinois Housing Development Authority, the
24 Illinois Finance Authority or the St. Louis Metropolitan Area

1 Airport Authority.
2     "School District" means any school district or special
3 charter district as defined in Section 1-3 of "The School
4 Code", approved March 18, 1961, as amended, or any
5 administrative district, or governing board, of a joint
6 agreement organized under Section 10-22.31 of the School Code.
7     "LEED" means Leadership in Energy and Environmental
8 Design.
9     "LEED green building rating system" means the
10 self-certifying, consensus-based, green building rating system
11 promulgated by the United States Green Building Council that
12 operates by evaluating a building's environmental performance
13 as to sustainable site planning, improving energy efficiency,
14 conserving materials and resources, embracing indoor
15 environmental quality, and safeguarding water. For purposes of
16 this Act, "LEED green building rating system" refers to the
17 LEED version in use on February 1, 2005.

20     Sec. 10.04. Construction and repair of buildings; green
21 building.
22     (a) To construct and repair, or contract for and supervise
23 the construction and repair of, buildings under the control of
24 or for the use of any State agency, as authorized by the
25 General Assembly. To the maximum extent feasible, any
26 construction or repair work shall utilize the best available
27 technologies for minimizing building energy costs as
28 determined through consultation with the Department of
29 Commerce and Economic Opportunity Community Affairs.
30     (b) On and after the effective date of this amendatory Act
31 of the 94th General Assembly, the Board shall initiate a series
32 of training workshops across the State to increase awareness
33 and understanding of green building techniques and the LEED

1 green building rating system. The workshops shall be designed
2 for relevant State agency staff, construction industry
3 personnel, and other interested parties.
4     The Board shall identify no less than 3 and no more than 5
5 construction projects to serve as case studies for using the
6 LEED green building rating system. Consideration shall be given
7 for a variety of representative building types in different
8 geographic regions of the State to provide additional
9 information and data related to the green building design and
10 construction process. The Board shall report its findings to
11 the General Assembly following the completion of the case study
12 projects and in no case later than December 31, 2008.
13     The Board shall establish a Green Building Advisory
14 Committee to assist the Board in determining guidelines for
15 which State construction and major renovation projects should
16 be developed to LEED green building standards (or a hybrid
17 version thereof). The guidelines should take into account the
18 size and type of buildings, financing considerations, and other
19 appropriate criteria. The guidelines must take effect within 3
20 years after the effective date of this amendatory Act of the
21 94th General Assembly and are subject to Board approval or
22 adoption. In addition to using the LEED green building rating
23 system (or a hybrid version thereof) in the building design
24 process, the Committee shall consider the feasibility of
25 requiring certain State construction projects to be LEED
26 certified.
27     This subsection (b) of this Section is repealed on January
28 1, 2009.

30     Section 99. Effective date. This Act takes effect January
31 1, 2006.".
