| AN ACT concerning education.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The School Code is amended by adding Section | 5 |
| 2-3.137 and
changing Section 3-14.20 as follows:
| 6 |
| (105 ILCS 5/2-3.137 new)
| 7 |
| Sec. 2-3.137. Inspection and review of school facilities; | 8 |
| task force.
| 9 |
| (a) The State Board of Education shall adopt rules for the
| 10 |
| documentation of school plan reviews and inspections of school | 11 |
| facilities,
including
the responsible individual's signature. | 12 |
| Such documents shall be kept on file
by the
regional
| 13 |
| superintendent of schools.
| 14 |
| (b) The State Board of Education shall convene a task force | 15 |
| for the
purpose of reviewing the documents required under rules | 16 |
| adopted under
subsection (a) of this
Section and making | 17 |
| recommendations regarding training and
accreditation
of | 18 |
| individuals performing reviews or inspections required under | 19 |
| Section
2-3.12,
3-14.20, 3-14.21, or 3-14.22 of this Code, | 20 |
| including regional
superintendents of schools and others | 21 |
| performing reviews or inspections
under the authority of a | 22 |
| regional superintendent (such as consultants,
municipalities, | 23 |
| and fire protection districts).
| 24 |
| The task force shall consist of
all of the following | 25 |
| members:
| 26 |
| (1) The Executive Director of the Capital Development | 27 |
| Board
or his or her designee and a staff representative of | 28 |
| the Division of Building Codes and Regulations.
| 29 |
| (2) The State Superintendent of Education or his or her
| 30 |
| designee.
| 31 |
| (3) A person appointed
by the State Board of Education.
| 32 |
| (4) A person appointed by an organization representing |

| school
administrators.
| 2 |
| (5) A person appointed by
an organization representing | 3 |
| suburban school administrators and school board
members.
| 4 |
| (6) A person appointed by an organization representing | 5 |
| architects.
| 6 |
| (7) A person appointed by an organization representing | 7 |
| regional
superintendents of schools.
| 8 |
| (8) A person appointed by an organization representing | 9 |
| fire inspectors.
| 10 |
| (9) A person appointed by an organization representing | 11 |
| Code
administrators.
| 12 |
| (10) A person appointed by an organization | 13 |
| representing plumbing
inspectors.
| 14 |
| (11) A person appointed by an organization that | 15 |
| represents both parents
and teachers.
| 16 |
| (12) A person appointed by an organization | 17 |
| representing municipal
governments in the State.
| 18 |
| The task force shall issue a report of its findings to the | 19 |
| Governor and the
General Assembly no later than June 30, 2005.

| Sec. 3-14.20. Building plans and specifications. To | 22 |
| inspect the building
plans and specifications, including but | 23 |
| not limited to plans and specifications
for the heating, | 24 |
| ventilating, lighting, seating, water supply, toilets and
| 25 |
| safety against fire of public school rooms and buildings | 26 |
| submitted to him by
school boards, and to approve all those | 27 |
| which comply substantially with the
building code authorized in | 28 |
| Section 2-3.12.
| 29 |
| If a municipality or,
in the
case of an unincorporated | 30 |
| area, a county or, if applicable, a fire
protection district | 31 |
| wishes to be notified of plans and specifications received
by a | 32 |
| regional office of education for any future
construction or | 33 |
| alteration of a public school facility located within that
| 34 |
| entity's
jurisdiction, then the entity must register this wish | 35 |
| with the regional
superintendent of schools. Within 10 days |

| after the regional superintendent of
schools receives the
plans | 2 |
| and specifications from a school board and prior to the bidding | 3 |
| process,
he or she shall notify, in writing, the registered | 4 |
| municipality and, if
applicable, the
registered fire | 5 |
| protection district where the school that is being
constructed | 6 |
| or altered lies that plans
and
specifications have been | 7 |
| received. In the case of an unincorporated area, the
registered | 8 |
| county
shall be notified. If the municipality, fire protection | 9 |
| district, or county
requests a review of
the plans and | 10 |
| specifications, then the school board shall submit a copy of | 11 |
| the
plans and
specifications. The municipality and, if | 12 |
| applicable, the fire protection
district or the county
may | 13 |
| comment in writing on the plans and specifications based on the | 14 |
| building
code
authorized in Section 2-3.12, referencing the | 15 |
| specific code where a discrepancy
has been
identified, and | 16 |
| respond back to the regional superintendent of schools within
| 17 |
| 15 days
after a copy of the plans and specifications have been | 18 |
| received or, if needed
for plan review, such additional time
as | 19 |
| agreed to by the regional superintendent of
schools. This | 20 |
| review must be at no cost to the school district.
The local | 21 |
| fire department or
fire protection district where the
school is | 22 |
| being constructed or altered may request a review of the plans
| 23 |
| and specifications. The regional superintendent of schools | 24 |
| shall submit
a copy of the plans and specifications within 10 | 25 |
| business days after the
request. The fire department or fire | 26 |
| protection district may comment
on the plans and specifications | 27 |
| based on the building code
authorized in Section 2-3.12 of the | 28 |
| Code and, if any
corrective action must be taken, shall respond | 29 |
| to the
regional superintendent of schools within 15 days after
| 30 |
| receipt of the plans and specifications. The Office of the
| 31 |
| State Fire Marshal may review the plans and specifications at
| 32 |
| the request of the fire department or fire protection
district. | 33 |
| The review must be conducted at no cost to the
school district.
| 34 |
| If
such plans and
specifications
are not approved or denied | 35 |
| approval by the regional superintendent of schools
within 3 | 36 |
| months after the date on which they are submitted to him or |

| her, the
school board may submit such plans and specifications | 2 |
| directly to the State
Superintendent of Education for approval | 3 |
| or denial.

| Section 99. Effective date. This Act takes effect upon | 6 |
| becoming law.
