2     AMENDMENT NO. ______. Amend Senate Bill 626 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The State Parks Designation Act is amended by
5 changing Section 1 as follows:

6     Sec. 6z-10. All monies received by the Department of
7 Natural Resources from the operation of the marina to be
8 located at Adeline Jay Geo-Karis Illinois Beach State Park and
9 to be known as Adeline Jay Geo-Karis Illinois Beach Marina,
10 including slip rentals, concession leases, and ground rents,
11 shall be deposited into a special fund known as the Adeline Jay
12 Geo-Karis Illinois Beach Marina Fund, which is hereby created
13 in the State Treasury. All interest earned on monies in this
14 Fund shall remain in the Fund.

17     Sec. 8.25c. (a) Beginning in fiscal year 1991 and
18 continuing through the third quarter of fiscal year 1993, the
19 State Comptroller shall order transferred and the State
20 Treasurer shall transfer from the Illinois Beach Marina Fund
21 (now known as the Adeline Jay Geo-Karis Illinois Beach Marina
22 Fund) to the General Revenue Fund 50% of the revenue deposited
23 into the Illinois Beach Marina Fund. Beginning in the fourth
24 quarter of fiscal year 1993 and thereafter until the sum of
25 $31,200,000 is paid to the General Revenue Fund, the State
26 Comptroller shall order transferred and the State Treasurer
27 shall transfer from the Adeline Jay Geo-Karis Illinois Beach
28 Marina Fund (formerly known as the Illinois Beach Marina Fund)
29 to the General Revenue Fund 25% of the first $2,000,000 of
30 revenue deposited into the Adeline Jay Geo-Karis Illinois Beach
31 Marina Fund (formerly known as the Illinois Beach Marina Fund)

1 in any fiscal year, and 75% of the revenue deposited into the
2 Adeline Jay Geo-Karis Illinois Beach Marina Fund (formerly
3 known as the Illinois Beach Marina Fund) in excess of
4 $2,000,000 in any fiscal year; however, such transfers shall
5 not exceed $2,000,000 in any fiscal year. In addition,
6 beginning in fiscal year 1991 and thereafter until the sum of
7 $8,000,000 is paid to the State Boating Act Fund the State
8 Comptroller shall order transferred and the State Treasurer
9 shall transfer from the Adeline Jay Geo-Karis Illinois Beach
10 Marina Fund (formerly known as the Illinois Beach Marina Fund)
11 to the State Boating Act Fund 15% of the revenue deposited into
12 the Adeline Jay Geo-Karis Illinois Beach Marina Fund (formerly
13 known as the Illinois Beach Marina Fund). Beginning in fiscal
14 year 1992, the transfers from the Adeline Jay Geo-Karis
15 Illinois Beach Marina Fund (formerly known as the Illinois
16 Beach Marina Fund) to the State Boating Act Fund shall be made
17 only at the direction of and in the amount authorized by the
18 Department of Natural Resources. Moneys transferred under
19 authorization of this Section to the State Boating Act Fund in
20 fiscal year 1992 before the effective date of this amendatory
21 Act of 1991 may be transferred to the Illinois Beach Marina
22 Fund (now known as the Adeline Jay Geo-Karis Illinois Beach
23 Marina Fund) at the direction of the Department of Natural
24 Resources. The transfers required under this Section shall be
25 made within 30 days after the end of each quarter based on the
26 State Comptroller's record of receipts for the quarter. The
27 initial transfers shall be made within 30 days after June 30,
28 1990 based on revenues received in the preceding quarter.
29 Additional transfers in excess of the limits established under
30 this Section may be authorized by the Department of Natural
31 Resources for accelerated payback of the amount due.
32     (b) The Department may, subject to appropriations by the
33 General Assembly, use monies in the Adeline Jay Geo-Karis
34 Illinois Beach Marina Fund (formerly known as the Illinois

1 Beach Marina Fund) to pay for operation, maintenance, repairs,
2 or improvements to the marina project; provided, however, that
3 payment of the amounts due under the terms of subsection (a)
4 shall have priority on all monies deposited in this Fund.
5     (c) Monies on deposit in excess of that needed for payments
6 to the General Revenue Fund and the State Boating Fund and in
7 excess of those monies needed for the operation, maintenance,
8 repairs, or improvements to the Adeline Jay Geo-Karis Illinois
9 Beach Marina as determined by the Department of Natural
10 Resources may be transferred at the discretion of the
11 Department to the State Parks Fund.

13     All of these transfers shall be made in equal quarterly
14 installments with the first made on the effective date of this
15 amendatory Act of the 94th General Assembly, or as soon
16 thereafter as practical, and with the remaining transfers to be
17 made on October 1, January 1, and April 1, or as soon
18 thereafter as practical. These transfers shall be made
19 notwithstanding any other provision of State law to the
20 contrary.
21     (b) On and after the effective date of this amendatory Act
22 of the 94th General Assembly through June 30, 2006, when any of
23 the funds listed in subsection (a) have insufficient cash from
24 which the State Comptroller may make expenditures properly
25 supported by appropriations from the fund, then the State
26 Treasurer and State Comptroller shall transfer from the General
27 Revenue Fund to the fund only such amount as is immediately
28 necessary to satisfy outstanding expenditure obligations on a
29 timely basis, subject to the provisions of the State Prompt
30 Payment Act. Any amounts transferred from the General Revenue
31 Fund to a fund pursuant to this subsection (b) from time to
32 time shall be re-transferred by the State Comptroller and the
33 State Treasurer from the receiving fund into the General

1 made into or receipts are collected by the receiving fund. In
2 all events, the full amounts of all transfers from the General
3 Revenue Fund to receiving funds shall be re-transferred to the
4 General Revenue Fund no later than June 30, 2006.
5     (c) Notwithstanding any other provision of law, on July 1,
6 2005, or as soon thereafter as may be practical, the State
7 Comptroller and the State Treasurer shall transfer $5,000,000
8 from the Communications Revolving Fund to the Hospital Basic
9 Services Prevention Fund.
