SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/2-105   from Ch. 95 1/2, par. 2-105

    Amends the Illinois Vehicle Code. Provides that any person 61 years of age or older applying at a driver services facility for renewal of his or her driver's license shall be provided, without charge, with a brochure warning the person of the dangers of financial identity theft. Provides that the Secretary of State shall prepare these brochures in consultation with the Department of Financial and Professional Regulation. Establishes requirements for the content of the brochures. Provides that the Secretary shall adopt rules for implementing the new provision.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 2-105 as follows:
 
6     (625 ILCS 5/2-105)  (from Ch. 95 1/2, par. 2-105)
7     Sec. 2-105. Offices of Secretary of State.
8     (a) The Secretary of State shall maintain offices in the
9 State capital and in such other places in the State as he may
10 deem necessary to properly carry out the powers and duties
11 vested in him.
12     (b) The Secretary of State may construct and equip one or
13 more buildings in the State of Illinois outside of the County
14 of Sangamon as he deems necessary to properly carry out the
15 powers and duties vested in him. The Secretary of State may, on
16 behalf of the State of Illinois, acquire public or private
17 property needed therefor by lease, purchase or eminent domain.
18 The care, custody and control of such sites and buildings
19 constructed thereon shall be vested in the Secretary of State.
20 Expenditures for the construction and equipping of any of such
21 buildings upon premises owned by another public entity shall
22 not be subject to the provisions of any State law requiring
23 that the State be vested with absolute fee title to the
24 premises. The exercise of the authority vested in the Secretary
25 of State by this Section is subject to the appropriation of the
26 necessary funds.
27     (c) Pursuant to Sections 4-6.2, 5-16.2, and 6-50.2 of the
28 Election Code, the Secretary of State shall make driver
29 services facilities available for use as temporary places of
30 registration. Registration within the offices shall be in the
31 most public, orderly and convenient portions thereof, and
32 Section 4-3, 5-3, and 11-4 of the Election Code relative to the

1 attendance of police officers during the conduct of
2 registration shall apply. Registration under this Section
3 shall be made in the manner provided by Sections 4-8, 4-10,
4 5-7, 5-9, 6-34, 6-35, and 6-37 of the Election Code.
5     (d) Within 30 days after the effective date of this
6 amendatory Act of 1990, and no later than November 1 of each
7 even-numbered year thereafter, the Secretary of State, to the
8 extent practicable, shall designate to each election authority
9 in the State a reasonable number of employees at each driver
10 services facility registered to vote within the jurisdiction of
11 such election authority and within adjacent election
12 jurisdictions for appointment as deputy registrars by the
13 election authority located within the election jurisdiction
14 where the employees maintain their residences. Such
15 designation shall be in writing and certified by the Secretary
16 of State.
17     (e) Each person applying at a driver services facility for
18 a driver's license or permit, a corrected driver's license or
19 permit, an Illinois identification card or a corrected Illinois
20 identification card shall be notified that the person may
21 register at such station to vote in the State and may also
22 transfer his voter registration at such station to a different
23 address in the State. Such notification may be made in writing
24 or verbally issued by an employee or the Secretary of State.
25     The Secretary of State shall promulgate such rules as may
26 be necessary for the efficient execution of his duties and the
27 duties of his employees under this amendatory Act of 1990.
28     (f) Any person 61 years of age or older applying at a
29 driver services facility for renewal of his or her driver's
30 license shall be provided, without charge, with a brochure
31 warning the person of the dangers of financial identity theft.
32 The Secretary shall prepare these brochures in consultation
33 with the Department of Financial and Professional Regulation.
34 The brochures shall (i) identify signs warning the reader that
35 he or she might be an intended victim of the crime of financial
36 identity theft, (ii) instruct the reader in how to proceed if

1 the reader believes that he or she is the victim of the crime
2 of identity theft, and (iii) provide the reader with names and
3 telephone numbers of law enforcement and other governmental
4 agencies that provide assistance to victims of financial
5 identity theft.
6     The Secretary shall adopt rules for implementing this
7 subsection (f).
