| AN ACT concerning State government.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Capital Development Board Act is amended by | 5 |
| changing Section 10.09-5 as follows:
| 6 |
| (20 ILCS 3105/10.09-5)
| 7 |
| Sec. 10.09-5. Standards for an energy code. To adopt rules , | 8 |
| by January 1,
2004, implementing a statewide energy code for | 9 |
| the construction or repair of
State facilities described in | 10 |
| Section 4.01. The energy code adopted by the
Board shall | 11 |
| incorporate standards promulgated by the American Society of
| 12 |
| Heating, Refrigerating and Air-conditioning Engineers, Inc., | 13 |
| (ASHRAE). In
proposing rules, the Board shall consult with the | 14 |
| Department of Commerce and
Economic Opportunity
Community | 15 |
| Affairs .

| Section 10. The Energy
Efficient Commercial Building Act is | 18 |
| amended by changing Section 10 as follows: | 19 |

| Sec. 10. Definitions.
| 21 |
| "Board" means the Capital Development Board.
| 22 |
| "Code" means the latest published edition of the | 23 |
| International Code Council's International Energy Conservation | 24 |
| Code, excluding published supplements but including
2000 | 25 |
| International Energy Conservation Code, the ASHRAE 90.1-1999 | 26 |
| Standard, which is included within that Code, the 2001
| 27 |
| supplement to that Code, and the adaptations to the Code that | 28 |
| are made by the
Board.
| 29 |
| "Commercial building" means any building except a building | 30 |
| that is a residential building, as defined in this Section. |

| "Department" means the Department of Commerce and Economic | 2 |
| Opportunity. | 3 |
| "Municipality" means any city, village, or incorporated | 4 |
| town.
| 5 |
| "Residential building" means (i) a detached one-family or | 6 |
| 2-family dwelling or (ii) any building that is 3 stories or | 7 |
| less in height above grade that contains multiple dwelling | 8 |
| units, in which the occupants reside on a primarily permanent | 9 |
| basis, such as a townhouse, a row house, an apartment house, a | 10 |
| convent, a monastery, a rectory, a fraternity or sorority | 11 |
| house, a dormitory, and a rooming house.

| Section 99. Effective date. This Act takes effect upon | 14 |
| becoming law.
