SYNOPSIS AS INTRODUCED:

    Amends the Mental Health and Developmental Disabilities Administrative Act, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, the University of Illinois Hospital Act, and the Hospital Licensing Act. Requires the Department of Public Health to perform certain functions in relation to the prevention and control of Multidrug-Resistant Organisms (MDROs). In particular, requires the Department to: (1) adopt rules for all health care facilities subject to licensure, certification, registration, or other regulation by the Department requiring compliance with the 2006 recommendations of the U.S. Centers for Disease Control and Prevention for the prevention and control of MDROs; (2) conduct a public information campaign for health care providers not subject to regulation by the Department; (3) create and administer a training program for health care providers; and (4) recommend and approve tests or testing procedures used in determining, preventing, and controlling MDRO infection. Requires hospitals (including the University of Illinois Hospital) and Department of Human Services mental health and developmental disability facilities to implement comprehensive interventions and routine testing procedures. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Mental Health and Developmental
5 Disabilities Administrative Act is amended by adding Section
6 10.5 as follows:
 
7     (20 ILCS 1705/10.5 new)
8     Sec. 10.5. Prevention and control of Multidrug-Resistant
9 Organisms. The Department, in consultation with the Department
10 of Public Health, shall adopt rules requiring facilities
11 described in Section 4 of this Act to implement comprehensive
12 interventions to prevent and control multidrug-resistant
13 organisms (MDROs), including methicillin-resistant
14 Staphylococcus aureus (MRSA), vancomycin-resistant
15 enterococcci (VRE), and certain gram-negative bacilli (GNB),
16 pursuant to prevention and control interventions recommended
17 by the U.S. Centers for Disease Control and Prevention (2006).
18 The Department shall also require facilities to submit reports
19 to the Department that contain substantially the same
20 information contained in the related infection reports
21 required to be submitted by hospitals to the Department of
22 Public Health under Section 25 of the Hospital Report Card Act.
23 The Department shall provide that information to the Department

1 of Public Health upon the Department of Public Health's
2 request.
3     In addition to requiring implementation of the
4 interventions recommended by the U.S. Centers for Disease
5 Control and Prevention, the Department shall require
6 facilities to establish and implement procedures for routinely
7 testing all patients for methicillin-resistant Staphylococcus
8 aureus (MRSA) (i) upon admission to the facility and (ii) on a
9 repeated basis as necessary to prevent the infection of other
10 facility patients or facility personnel or visitors.
 
11     Section 10. The Department of Public Health Powers and
12 Duties Law of the Civil Administrative Code of Illinois is
13 amended by adding Section 2310-312 as follows:
 
14     (20 ILCS 2310/2310-312 new)
15     Sec. 2310-312. Multidrug-Resistant Organisms. The
16 Department shall perform the following functions in relation to
17 the prevention and control of Multidrug-Resistant Organisms
18 (MDROs), including methicillin-resistant Staphylococcus aureus
19 (MRSA), vancomycin-resistant (VRE) and certain gram-negative
20 bacilli (GNB), as these terms are referenced by the United
21 States Centers for Disease Control and Prevention:
22         (1) The Department shall adopt administrative rules
23     for all health care facilities subject to licensure,
24     certification, registration, or other regulation by the

1     Department requiring compliance with the 2006
2     recommendations of the U.S. Centers for Disease Control and
3     Prevention for the prevention and control of
4     Multidrug-Resistant Organisms (MDROs).
5         (2) The Department shall conduct a public information
6     campaign for health care providers not subject to
7     regulation by the Department, including physicians, health
8     facilities, public health departments, other public and
9     private health care providers, laboratories, and the
10     general public, on Multidrug Resistant Organisms (MDROs)
11     to reduce the incidence of infection. This program shall
12     include, but need not be limited to, the establishment of a
13     statewide information clearinghouse that will provide
14     periodic reports and releases to public officials, health
15     professionals, and the general public regarding new
16     developments or procedures concerning prevention and
17     treatment of MDROs.
18         (3) The Department shall create and administer a
19     training program for health care providers who have a need
20     for understanding matters relating to MDROs. The training
21     shall include information on the cause and effects of MDROs
22     and the means of preventing and controlling transmission.
23     The training may be made available to public employees and
24     the employees of private agencies. The Department may
25     charge fees to cover the costs of the training.
26         (4) The Department shall recommend and approve tests or

1     testing procedures used in determining, preventing, and
2     controlling MDRO infection.
 
3     Section 15. The University of Illinois Hospital Act is
4 amended by adding Section 7 as follows:
 
5     (110 ILCS 330/7 new)
6     Sec. 7. Prevention and control of Multidrug-Resistant
7 Organisms. The University, in consultation with the Department
8 of Public Health, shall adopt rules requiring the University of
9 Illinois hospital to implement comprehensive interventions to
10 prevent and control multidrug-resistant organisms (MDROs),
11 including methicillin-resistant Staphylococcus aureus (MRSA),
12 vancomycin-resistant enterococcci (VRE), and certain
13 gram-negative bacilli (GNB), pursuant to prevention and
14 control interventions recommended by the U.S. Centers for
15 Disease Control and Prevention (2006). The University shall
16 also require the Hospital to submit reports to the University
17 that contain substantially the same information contained in
18 the related infection reports required to be submitted by
19 hospitals to the Department of Public Health under Section 25
20 of the Hospital Report Card Act. The University shall provide
21 that information to the Department of Public Health upon the
22 Department's request.
23     In addition to requiring implementation of the

7 or hospital personnel or visitors.
 
8     Section 20. The Hospital Licensing Act is amended by adding
9 Section 6.23 as follows:
 
10     (210 ILCS 85/6.23 new)
11     Sec. 6.23. Prevention and control of Multidrug-Resistant
12 Organisms. The Department shall adopt rules requiring
13 hospitals licensed under this Act to implement comprehensive
14 interventions to prevent and control multidrug-resistant
15 organisms (MDROs), including methicillin-resistant
16 Staphylococcus aureus (MRSA), vancomycin-resistant
17 enterococcci (VRE), and certain gram-negative bacilli (GNB),
18 pursuant to prevention and control interventions recommended
19 by the U.S. Centers for Disease Control and Prevention (2006).
20 The Department shall also require hospitals to submit related
21 infection reports under Section 25 of the Hospital Report Card
22 Act.
23     In addition to requiring implementation of the

8 becoming law.
