AMENDMENT TO HOUSE BILL 192

2     AMENDMENT NO. ______. Amend House Bill 192, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Mental Health and Developmental
6 Disabilities Administrative Act is amended by adding Section
7 10.5 as follows:
 
8     (20 ILCS 1705/10.5 new)
9     Sec. 10.5. Prevention and control of Multidrug-Resistant
10 Organisms. The Department, in consultation with the Department
11 of Public Health, shall adopt rules that may require one or
12 more of the facilities described in Section 4 of this Act to
13 implement comprehensive interventions to prevent and control
14 multidrug-resistant organisms (MDROs), including
15 methicillin-resistant Staphylococcus aureus (MRSA),
16 vancomycin-resistant enterococci (VRE), and certain

1 gram-negative bacilli (GNB), pursuant to prevention and
2 control interventions recommended by the U.S. Centers for
3 Disease Control and Prevention (2006). The Department shall
4 also require facilities to submit reports to the Department
5 that contain substantially the same information contained in
6 the related infection reports required to be submitted by
7 hospitals to the Department of Public Health under Section 25
8 of the Hospital Report Card Act. The Department shall provide
9 that information to the Department of Public Health upon the
10 Department of Public Health's request.
 
11     Section 10. The Department of Public Health Powers and
12 Duties Law of the Civil Administrative Code of Illinois is
13 amended by adding Section 2310-312 as follows:
 
14     (20 ILCS 2310/2310-312 new)
15     Sec. 2310-312. Multidrug-Resistant Organisms. The
16 Department shall perform the following functions in relation to
17 the prevention and control of Multidrug-Resistant Organisms
18 (MDROs), including methicillin-resistant Staphylococcus aureus
19 (MRSA), vancomycin-resistant (VRE) and certain gram-negative
20 bacilli (GNB), as these terms are referenced by the United
21 States Centers for Disease Control and Prevention:
22         (1) Except with regard to hospitals, for which
23     administrative rules shall be adopted in accordance with
24     Section 6.23 of the Hospital Licensing Act and Section 7 of

1     the University of Illinois Hospital Act, the Department
2     shall adopt administrative rules for health care
3     facilities subject to licensure, certification,
4     registration, or other regulation by the Department that
5     may require one or more types of those facilities to
6     develop an infection control policy for MDROs that takes
7     into consideration the 2006 recommendations of the U.S.
8     Centers for Disease Control and Prevention for the
9     prevention and control of Multidrug-Resistant Organisms
10     (MDROs).
11         (2) The Department shall conduct a public information
12     campaign for health care providers not subject to
13     regulation by the Department, including physicians, health
14     facilities, public health departments, other public and
15     private health care providers, laboratories, and the
16     general public, on Multidrug Resistant Organisms (MDROs)
17     to reduce the incidence of infection. This program shall
18     include, but need not be limited to, the establishment of a
19     statewide information clearinghouse that will provide
20     periodic reports and releases to public officials, health
21     professionals, and the general public regarding new
22     developments or procedures concerning prevention and
23     treatment of MDROs.
24         (3) The Department shall create and administer a
25     training program for health care providers who have a need
26     for understanding matters relating to MDROs. The training

1     shall include information on the cause and effects of MDROs
2     and the means of preventing and controlling transmission.
3     The training may be made available to public employees and
4     the employees of private agencies. The Department may
5     charge fees to cover the costs of the training.
 
6     Section 15. The University of Illinois Hospital Act is
7 amended by adding Section 7 as follows:
 
8     (110 ILCS 330/7 new)
9     Sec. 7. Prevention and control for Multidrug-Resistant
10 Organisms. The University shall develop an infection control
11 policy for the University of Illinois hospital to implement
12 comprehensive interventions to prevent and control
13 multidrug-resistant organisms (MDROs), including
14 methicillin-resistant Staphylococcus aureus (MRSA),
15 vancomycin-resistant enterococci (VRE), and certain
16 gram-negative bacilli (GNB) that takes into consideration the
17 guidelines of the U.S. Centers for Disease Control and
18 Prevention for the management of MDROs in healthcare settings.
19 The University shall also require the Hospital to submit
20 reports to the University that contain substantially the same
21 information contained in the related infection reports
22 required to be submitted by hospitals to the Department of
23 Public Health under Section 25 of the Hospital Report Card Act.
24 The University shall provide that information to the Department

1 of Public Health upon the Department's request.
 
2     Section 20. The Hospital Licensing Act is amended by adding
3 Section 6.23 as follows:
 
4     (210 ILCS 85/6.23 new)
5     Sec. 6.23. Prevention and control of Multidrug-Resistant
6 Organisms. Each hospital shall develop an infection control
7 policy to implement comprehensive interventions to prevent and
8 control multidrug-resistant organisms (MDROs), including
9 methicillin-resistant Staphylococcus aureus (MRSA),
10 vancomycin-resistant enterococci (VRE), and certain
11 gram-negative bacilli (GNB) that takes into consideration the
12 guidelines of the U.S. Centers for Disease Control and
13 Prevention for the management of MDROs in healthcare settings.
14 The Department shall also require hospitals to submit related
15 infection reports under Section 25 of the Hospital Report Card
16 Act.
 
17     Section 99. Effective date. This Act takes effect upon
18 becoming law.".
