AMENDMENT TO HOUSE BILL 291

2     AMENDMENT NO. ______. Amend House Bill 291 on page 11, line
3 5, by inserting after "1987" the following:
4 "or a minor for whom an independent basis of abuse, neglect, or
5 dependency exists, which must be defined by departmental rule.
6 An independent basis exists when the allegations or
7 adjudication of abuse, neglect, or dependency do not arise from
8 the same facts, incident, or circumstances which give rise to a
9 charge or adjudication of delinquency"; and
 
10 on page 27, line 2, by replacing "," with ". ,"; and
 
11 on page 27, by replacing line 3 with the following:
12 "An independent basis exists when the allegations or
13 adjudication of abuse, neglect, or dependency do not arise from
14 the same facts, incident, or circumstances which give rise to a
15 charge or adjudication of delinquency which must be defined by
16 departmental rule.

1     In placing the"; and
 
2 on page 40, line 6, by inserting after "Act" the following:
3 "or a minor for whom an independent basis of abuse, neglect, or
4 dependency exists. An independent basis exists when the
5 allegations or adjudication of abuse, neglect, or dependency do
6 not arise from the same facts, incident, or circumstances which
7 give rise to a charge or adjudication of delinquency"; and
 
8 on page 44, line 23, by inserting after "age" the following:
9 "or, pursuant to Article II of this Act, a minor for whom an
10 independent basis of abuse, neglect, or dependency exists. An
11 independent basis exists when the allegations or adjudication
12 of abuse, neglect, or dependency do not arise from the same
13 facts, incident, or circumstances which give rise to a charge
14 or adjudication of delinquency".
