SYNOPSIS AS INTRODUCED:

    Amends the School Breakfast and Lunch Program Act. Strongly encourages a school board (including the board of a private school) to publish the school lunch menu and the nutrition content, including calories, of each meal item. Provides that a school board may determine the frequency and manner of publication. Amends the Critical Health Problems and Comprehensive Health Education Act. Requires a comprehensive health education program to include instruction in secondary schools on clinical depression and suicide prevention. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Breakfast and Lunch Program Act is
5 amended by adding Section 3.5 as follows:
 
6     (105 ILCS 125/3.5 new)
7     Sec. 3.5. Publication of lunch menu. All school boards are
8 strongly encouraged to publish the school lunch menu and the
9 nutrition content, including calories, of each meal item.
10     A school board may determine the frequency and manner of
11 publication.
 
12     Section 10. The Critical Health Problems and Comprehensive
13 Health Education Act is amended by changing Section 3 as
14 follows:
 
15     (105 ILCS 110/3)  (from Ch. 122, par. 863)
16     Sec. 3. Comprehensive Health Education Program. The
17 program established under this Act shall include, but not be
18 limited to, the following major educational areas as a basis
19 for curricula in all elementary and secondary schools in this
20 State: human ecology and health, human growth and development,
21 the emotional, psychological, physiological, hygienic and

1 social responsibilities of family life, including sexual
2 abstinence until marriage, prevention and control of disease,
3 including instruction in grades 6 through 12 on the prevention,
4 transmission and spread of AIDS, public and environmental
5 health, consumer health, safety education and disaster
6 survival, mental health and illness (including instruction in
7 secondary schools on clinical depression and suicide
8 prevention), personal health habits, alcohol, drug use, and
9 abuse including the medical and legal ramifications of alcohol,
10 drug, and tobacco use, abuse during pregnancy, sexual
11 abstinence until marriage, tobacco, nutrition, and dental
12 health. The program shall also provide course material and
13 instruction to advise pupils of the Abandoned Newborn Infant
14 Protection Act. Notwithstanding the above educational areas,
15 the following areas may also be included as a basis for
16 curricula in all elementary and secondary schools in this
17 State: basic first aid (including, but not limited to,
18 cardiopulmonary resuscitation and the Heimlich maneuver),
19 early prevention and detection of cancer, heart disease,
20 diabetes, stroke, and the prevention of child abuse, neglect,
21 and suicide. The school board of each public elementary and
22 secondary school in the State shall encourage all teachers and
23 other school personnel to acquire, develop, and maintain the
24 knowledge and skills necessary to properly administer
25 life-saving techniques, including without limitation the
26 Heimlich maneuver and rescue breathing. The training shall be

1 in accordance with standards of the American Red Cross, the
2 American Heart Association, or another nationally recognized
3 certifying organization. A school board may use the services of
4 non-governmental entities whose personnel have expertise in
5 life-saving techniques to instruct teachers and other school
6 personnel in these techniques. Each school board is encouraged
7 to have in its employ, or on its volunteer staff, at least one
8 person who is certified, by the American Red Cross or by
9 another qualified certifying agency, as qualified to
10 administer first aid and cardiopulmonary resuscitation. In
11 addition, each school board is authorized to allocate
12 appropriate portions of its institute or inservice days to
13 conduct training programs for teachers and other school
14 personnel who have expressed an interest in becoming qualified
15 to administer emergency first aid or cardiopulmonary
16 resuscitation. School boards are urged to encourage their
17 teachers and other school personnel who coach school athletic
18 programs and other extracurricular school activities to
19 acquire, develop, and maintain the knowledge and skills
20 necessary to properly administer first aid and cardiopulmonary
21 resuscitation in accordance with standards and requirements
22 established by the American Red Cross or another qualified
23 certifying agency. No pupil shall be required to take or
24 participate in any class or course on AIDS or family life
25 instruction if his parent or guardian submits written objection
26 thereto, and refusal to take or participate in the course or

1 program shall not be reason for suspension or expulsion of the
2 pupil.
3     Curricula developed under programs established in
4 accordance with this Act in the major educational area of
5 alcohol and drug use and abuse shall include classroom
6 instruction in grades 5 through 12. The instruction, which
7 shall include matters relating to both the physical and legal
8 effects and ramifications of drug and substance abuse, shall be
9 integrated into existing curricula; and the State Board of
10 Education shall develop and make available to all elementary
11 and secondary schools in this State instructional materials and
12 guidelines which will assist the schools in incorporating the
13 instruction into their existing curricula. In addition, school
14 districts may offer, as part of existing curricula during the
15 school day or as part of an after school program, support
16 services and instruction for pupils or pupils whose parent,
17 parents, or guardians are chemically dependent.

19     Section 90. The State Mandates Act is amended by adding
20 Section 8.31 as follows:

22     Sec. 8.31. Exempt mandate. Notwithstanding Sections 6 and 8
23 of this Act, no reimbursement by the State is required for the
24 implementation of any mandate created by this amendatory Act of

2     Section 99. Effective date. This Act takes effect upon
3 becoming law.
