| AMENDMENT TO HOUSE BILL 680

| AMENDMENT NO. ______. Amend House Bill 680 by replacing | 3 |
| everything after the enacting clause with the following:

| "Section 1. Short title. This Act may be cited as the | 5 |
| Biomonitoring Safety Net Act. | 6 |
| Section 5. Findings and purposes. | 7 |
| (a) The General Assembly finds all of the following: | 8 |
| (1) An estimated 100,000 chemicals are registered for | 9 |
| use today in the United States. Another 2,000 chemicals are | 10 |
| added each year. | 11 |
| (2) Some toxicological screening data exists for only | 12 |
| 7% to 10% of these chemicals. More than 90% of these | 13 |
| chemicals have never been tested for their effects on human | 14 |
| health. Large numbers of these chemicals are found in | 15 |
| cosmetics, personal care products, pesticides, food dyes, | 16 |
| cleaning products, fuels, and plastics. |

| (3) As a result, people are exposed to chemicals daily. | 2 |
| Many of these chemicals persist in the environment or | 3 |
| accumulate and remain in body fat and have been shown to be | 4 |
| toxic. | 5 |
| (4) The Centers for Disease Control and Prevention has | 6 |
| documented the presence of 148 environmental chemicals in | 7 |
| the blood and urine of Americans of all ages and races. | 8 |
| (b) The purposes of this Act are as follows: | 9 |
| (1) for the University of Illinois at Chicago, the | 10 |
| Great Lakes Center for Occupational and Environmental | 11 |
| Safety and Health, to conduct an environmental contaminant | 12 |
| biomonitoring feasibility study that proposes the best way | 13 |
| to monitor the presence and concentration of designated | 14 |
| chemicals in the bodies of the people of this State; | 15 |
| (2) to produce biomonitoring studies that provide data | 16 |
| helping scientists, researchers, public health personnel, | 17 |
| and community members explore linkages between chemical | 18 |
| exposure and health concerns; and | 19 |
| (3) to support Illinois public health by establishing | 20 |
| trends in chemical exposures, validating modeling and | 21 |
| survey methods, supporting epidemiological studies, | 22 |
| identifying highly exposed communities, addressing the | 23 |
| data gaps between chemical exposures and specific health | 24 |
| outcomes, informing health responses to unanticipated | 25 |
| emergency exposures, assessing the effectiveness of | 26 |
| current regulations, and setting priorities for reform. |

| Section 10. Definitions. As used in this Act: | 2 |
| "Agency" means the Illinois Environmental Protection | 3 |
| Agency. | 4 |
| "Department" means the Department of Public Health. | 5 |
| "Program" means the Environmental Contaminant | 6 |
| Biomonitoring Program. | 7 |
| Section 15. Scientific Guidance Panel. In implementing the | 8 |
| Program, the Department and the Agency shall establish a | 9 |
| Scientific Guidance Panel. The Directors of the Department and | 10 |
| the Agency shall appoint the members of the Panel. The Panel | 11 |
| shall be composed of 11 members, whose expertise shall | 12 |
| encompass the disciplines of public health, epidemiology, | 13 |
| biostatistics, environmental medicine, risk analysis, exposure | 14 |
| assessment, developmental biology, laboratory sciences, | 15 |
| bioethics, maternal and child health with a specialty in | 16 |
| breastfeeding, and toxicology. Members shall be appointed for | 17 |
| 2-year terms. Members may be reappointed for additional terms | 18 |
| without limitation. Members shall serve until their successors | 19 |
| are appointed and have qualified. Vacancies shall be filled in | 20 |
| the same manner as the original appointments, and any member so | 21 |
| appointed shall serve during the remainder of the term for | 22 |
| which the vacancy occurred. The Panel shall meet, at a minimum, | 23 |
| 3 times per year. The Agency shall be responsible for staffing | 24 |
| and administration of the Panel. Members of the Panel shall be |

| reimbursed for travel and other necessary expenses incurred in | 2 |
| the performance of their duties under this Act, but shall not | 3 |
| receive a salary or compensation. | 4 |
| The Panel shall provide guidance to the University of | 5 |
| Illinois at Chicago, the Great Lakes Center for Occupational | 6 |
| and Environmental Safety and Health, and make recommendations | 7 |
| regarding the design and implementation of the feasibility | 8 |
| study, including specific recommendations for chemicals that | 9 |
| are priorities for biomonitoring. The Panel shall recommend | 10 |
| priority chemicals for inclusion in the Program using all of | 11 |
| the following criteria: | 12 |
| (1) The degree of potential exposure to the public or | 13 |
| specific subgroups, including, but not limited to, certain | 14 |
| occupations. | 15 |
| (2) The likelihood of a chemical being a carcinogen or | 16 |
| toxicant based on peer-reviewed health data, its chemical | 17 |
| structure, or the toxicology of chemically related | 18 |
| compounds. | 19 |
| (3) The limits of laboratory detection for the | 20 |
| chemical, including the ability to detect the chemical at | 21 |
| levels low enough to be expected in the general population. | 22 |
| (4) Any other criteria the Panel deems significant. | 23 |
| The Panel may recommend additional designated chemicals | 24 |
| not included in the National Report on Human Exposure to | 25 |
| Environmental Chemicals for inclusion in the Program using all | 26 |
| of the following criteria: |

| (A) Exposure or potential exposure to the public or | 2 |
| specific subgroups. | 3 |
| (B) The known or suspected health effects resulting | 4 |
| from some level of exposure based on peer-reviewed | 5 |
| scientific studies. | 6 |
| (C) The need to assess the efficacy of public health | 7 |
| actions to reduce exposure to a chemical. | 8 |
| Section 20. Feasibility study report. Two years after the | 9 |
| effective date of this Act, the University of Illinois at | 10 |
| Chicago, the Great Lakes Center for Occupational and | 11 |
| Environmental Safety and Health, shall submit a report to the | 12 |
| Governor and the General Assembly containing findings of the | 13 |
| feasibility study and shall include in the report recommended | 14 |
| activities and estimated costs of establishing an Illinois | 15 |
| Environmental Contaminant Biomonitoring Program.".
