SYNOPSIS AS INTRODUCED:

    Amends the School Construction Law. Requires the Capital Development Board to establish a written procedure for disbursement of school construction project grant funds, which shall incorporate the requirement that school construction projects of school districts that do not receive a school construction project grant award in a fiscal year due to lack of adequate appropriations shall be placed ahead of any new school construction projects that are approved for grant awards in following fiscal years. Provides that the Capital Development Board may not, under any circumstances, deviate from this procedure for disbursement. Makes a related change in a provision concerning carry-over projects.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Construction Law is amended by
5 changing Sections 5-15 and 5-37 as follows:
 
6     (105 ILCS 230/5-15)
7     Sec. 5-15. Grant entitlements. The State Board of Education
8 is authorized to issue grant entitlements for school
9 construction projects and debt service and shall determine the
10 priority order for school construction project grants to be
11 made by the Capital Development Board. When issuing a grant
12 entitlement for a school construction project, the Capital
13 Development Board, as a part of that entitlement, shall certify
14 to the district receiving the entitlement the dollar amount of
15 the school construction project's cost that the district will
16 be required to finance with non-grant funds in order to qualify
17 to receive a school construction project grant under this
18 Article from the Capital Development Board. The Capital
19 Development Board shall establish a written procedure for
20 disbursement of school construction project grant funds, which
21 shall incorporate the requirements of Section 5-37 of this Law.
22 The Capital Development Board may not, under any circumstances,
23 deviate from this procedure for disbursement.

3     Sec. 5-37. Carry over projects. If a school district has
4 been issued a grant entitlement for a school construction
5 project, has arranged and approved all local financing, and is
6 eligible to receive a school construction project grant award
7 in any fiscal year, but does not receive such award in that
8 year due to lack of adequate appropriations, such school
9 construction projects shall be placed ahead of any new school
10 construction projects within the same priority category as
11 defined in Section 5-30 that are approved for grant awards in
12 for the following fiscal years year.
