Amends the Illinois Public Aid Code. In provisions concerning services for children under Medicaid, changes references from "disabled children" and "severely mentally ill or emotionally disturbed children" to "children with disabilities" and "children with severe mental illness or emotional disturbance". Requires the Department of Healthcare and Family Services to make an annual report concerning Medicaid services offered to children with disabilities, and sets forth items that must be included in the report. Effective immediately.

| AN ACT concerning public aid.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Illinois Public Aid Code is amended by | 5 |
| changing Section 5-2.05 as follows:
| 6 |
| (305 ILCS 5/5-2.05)
| 7 |
| Sec. 5-2.05. Children with disabilities
Disabled children .
| 8 |
| (a) The Department of Healthcare and Family Services
Public | 9 |
| Aid may offer, to children with developmental
disabilities or | 10 |
| children with severe mental illness or emotional disturbance
| 11 |
| and severely mentally ill or emotionally disturbed children who
| 12 |
| otherwise would not qualify for medical assistance under this | 13 |
| Article due to
family income, home-based and community-based | 14 |
| services instead of institutional
placement, as allowed under | 15 |
| paragraph 7 of Section 5-2.
| 16 |
| (b) The Department of Healthcare and Family Services
Public | 17 |
| Aid , in conjunction with the Department of
Human Services and | 18 |
| the Division of Specialized Care for Children, University of
| 19 |
| Illinois-Chicago, shall submit an annual
also
report to the | 20 |
| Governor and the General Assembly no
later than January of each | 21 |
| year beginning in 2008
1, 2004 regarding the status of existing
| 22 |
| services offered
under paragraph 7
of Section 5-2. This report | 23 |
| shall include, but not be limited to, the following

| information:
| 2 |
| (1) The number of persons eligible for these services.
| 3 |
| (2) The number of persons who applied for these | 4 |
| services.
| 5 |
| (3) The number of persons who currently receive these | 6 |
| services.
| 7 |
| (4) The number of persons who aged out of the | 8 |
| children's program and, of those persons, the number who | 9 |
| have been transitioned into the home services program or | 10 |
| another program funded by the Department of Healthcare and | 11 |
| Family Services. | 12 |
| (5) The nature, scope, and cost of services provided | 13 |
| under paragraph 7 of
Section 5-2.

| (6)
(5) The comparative cost of providing those | 15 |
| services in a hospital,
skilled nursing facility, or | 16 |
| intermediate care facility.
| 17 |
| (7)
(6) The funding sources for the provision of | 18 |
| services, including federal
financial participation.
| 19 |
| (8)
(7) The qualifications, skills, and availability | 20 |
| of caregivers for
children receiving services.
| 21 |
| (9) For persons who have aged out of the children's | 22 |
| program and are receiving services under the home services | 23 |
| program or other services funded by the Department of | 24 |
| Healthcare and Family Services, the level of satisfaction | 25 |
| of the customer and his or her parents, guardian, or other | 26 |
| adult caretaker with current services as determined |

| through surveys and other direct methods of information | 2 |
| collection.
| 3 |
| The report shall also include information regarding the | 4 |
| extent to which the
existing programs could provide coverage | 5 |
| for children with developmental disabilities or children with | 6 |
| severe mental illness or emotional disturbance
mentally | 7 |
| disabled children who are
currently being provided services in | 8 |
| an institution who could otherwise be
served in a | 9 |
| less-restrictive, community-based setting for the same or a | 10 |
| lower
cost.

| Section 99. Effective date. This Act takes effect upon | 13 |
| becoming law.
