| AMENDMENT TO HOUSE BILL 2166

| AMENDMENT NO. ______. Amend House Bill 2166 by replacing | 3 |
| everything after the enacting clause with the following:
| 4 |
| "Section 5. The Solid Waste Planning and Recycling Act is | 5 |
| amended by changing Sections 6 and 8 as follows:
| 6 |
| (415 ILCS 15/6) (from Ch. 85, par. 5956)
| 7 |
| Sec. 6. Each county waste management plan adopted under | 8 |
| Section 4
shall include a recycling program. Such recycling | 9 |
| program:
| 10 |
| (1) shall be implemented throughout the county and include | 11 |
| a time
schedule for implementation of the program.
| 12 |
| (2) shall provide for the designation of a recycling | 13 |
| coordinator to
administer the program.
| 14 |
| (3) shall be designed to recycle, by the end of the third | 15 |
| and fifth years
of the program, respectively 15% and 25% of the | 16 |
| municipal waste generated
in the county, subject to the |

| existence of a viable market for the recycled
material, based | 2 |
| on measurements of recycling and waste generated in terms
of | 3 |
| weight. The determination of recycling rate shall not include: | 4 |
| discarded
motor vehicles, wastes used for clean fill or erosion | 5 |
| control, or
commercial, institutional or industrial machinery | 6 |
| or equipment.
| 7 |
| (4) may provide for the construction and operation of one | 8 |
| or more
recycling centers by a unit of local government, or for | 9 |
| contracting with
other public or private entities for the | 10 |
| operation of recycling centers.
| 11 |
| (5) may require residents of the county to separate | 12 |
| recyclable materials
at the time of disposal or trash pick-up.
| 13 |
| (6) may make special provision for commercial and | 14 |
| institutional
establishments that implement their own | 15 |
| specialized recycling programs,
provided that such | 16 |
| establishments annually provide written documentation to
the | 17 |
| county of the total number of tons of material recycled.
| 18 |
| (7) shall provide for separate collection and composting of | 19 |
| leaves.
| 20 |
| (8) shall include public education and notification | 21 |
| programs to foster
understanding of and encourage compliance | 22 |
| with the recycling program.
| 23 |
| (9) shall include provisions for compliance, including | 24 |
| incentives and
penalties.
| 25 |
| (10) shall include provisions for (i) recycling the | 26 |
| collected
materials, (ii) identifying potential markets for at |

| least 3 recyclable
materials, and
(iii) promoting the use of | 2 |
| products made from recovered or recycled
materials among | 3 |
| businesses, newspapers and local governments in the county.
| 4 |
| (11) may provide for the payment of recycling diversion | 5 |
| credits to
public and private parties engaged in recycling | 6 |
| activities.
| 7 |
| (12) shall provide for separate collection of compact discs | 8 |
| and digital video discs.

| 11 |
| Sec. 8. (a) Any municipality or combination of | 12 |
| municipalities that
has a total population of 20,000 or more | 13 |
| may apply to the Department for
assistance grants to operate a | 14 |
| pilot recycling project that demonstrates
the economic | 15 |
| feasibility and environmental benefits of a recycling method.
| 16 |
| Population shall be determined by the most recent federal | 17 |
| decennial census.
| 18 |
| The pilot recycling project shall include, at a minimum, | 19 |
| the following elements:
| 20 |
| (1) A curbside program requiring the occupants of at least | 21 |
| 3,000 single
family residences to separate at least 3 materials | 22 |
| deemed appropriate by
the municipality from other solid waste | 23 |
| generated at their residences, and
to store such material until | 24 |
| collection; the 3 materials shall be chosen
from the following: | 25 |
| glass, aluminum, steel and bimetallic cans, newsprint,

| corrugated paper, used motor oil, plastics , or compact discs | 2 |
| and digital video discs .
| 3 |
| (2) A scheduled day, at least twice per month, during which | 4 |
| separated
materials are to be placed at the curbside or a | 5 |
| similar location for collection.
| 6 |
| (3) A system including trucks and related equipment for | 7 |
| collecting
recyclable materials from the curbside or similar | 8 |
| locations at least twice
per month from each participating | 9 |
| residence.
| 10 |
| (4) A drop-off or buy-back center for the collection and | 11 |
| sale or reuse
of recyclable materials, including but not | 12 |
| limited to glass, aluminum cans
and newsprint.
| 13 |
| (5) Provisions for recycling of collected materials.
| 14 |
| (6) Provisions for public education and compliance.
| 15 |
| (b) The Department shall establish guidelines for | 16 |
| solicitation of grants
under this Section. Applications for | 17 |
| assistance shall be filed with the
Department on forms provided | 18 |
| by the Department and shall set forth such
information as may | 19 |
| be required by the Department. The Department shall
evaluate | 20 |
| the application and notify the applicant of the qualification | 21 |
| or
non-qualification of the application within 45 days of the | 22 |
| deadline
established by the Department for receipt of | 23 |
| applications.
| 24 |
| (c) In implementing this Section, the Department shall, | 25 |
| pursuant to
appropriation, make grants from the Solid Waste | 26 |
| Management Fund to
municipalities with approved pilot |

| recycling projects. Such grants shall
be limited to 50% of the | 2 |
| project costs, not to exceed a total of $50,000 per project.
| 3 |
| (d) No more than 25 pilot recycling project grants may be | 4 |
| made pursuant
to this Section.
