AMENDMENT TO HOUSE BILL 2651

2     AMENDMENT NO. ______. Amend House Bill 2651, AS AMENDED,
3 with reference to page and line numbers of Senate Amendment No.
4 3, on page 91, line 11, after the period, by inserting "The
5 Auditor General shall verify the accuracy of the Department's
6 reporting with an audit every 2 years."; and
 
7 on page 96, line 14, by replacing "Seventy" with "Sixty"; and
 
8 on page 96, line 17, by replacing "Five" with "Fifteen"; and
 
9 on page 96, lines 20 through 22, by deleting "School districts
10 organized under Article 34 of the School Code are not eligible
11 for these funds."; and
 
12 on page 98, line 23, after "Fund," by inserting "the Illinois
13 Works Fund, the Illinois Works Debt Service Fund, the Illinois
14 Education Trust Fund, the Leaking Underground Storage Tank

1 (LUST) Fund, the Focusing on Children, Uplifting Schools
2 (FOCUS) Fund, the Depressed Communities Economic Development
3 Fund, the Illinois Casino Development Authority Fund,"; and
 
4 on page 130, line 21 and line 22, by replacing "Illinois Works
5 Fund" each time it appears with "Illinois Works Debt Service
6 Fund"; and
 
7 on page 207, by replacing lines 4 through 6 with the following:
8 "non-host licensees and advance deposit wagering licensees
9 shall carry the signal of and accept wagers on live racing of
10 all organization licensees. Advance deposit wagering licensees
11 shall not be permitted to accept out-of-state wagers on any
12 Illinois signal provided pursuant to this Section without the
13 approval and consent of the organization licensee providing the
14 signal. Non-host licensees may carry the host track simulcast
15 program and shall accept wagers on all races included as part
16 of the simulcast program upon which wagering is permitted. All
17 organization licensees shall provide their live signal to all
18 advance deposit wagering licensees for a simulcast commission
19 fee not to exceed 6% of the advance deposit wagering licensee's
20 Illinois handle on the organization licensee's signal without
21 prior approval by the Board. The Board may adopt rules under
22 which it may permit simulcast commission fees in excess of 6%.
23 However, organization licensees providing live signals
24 pursuant to the requirements of this subsection (g) may

1 petition the Board to withhold their live signals from an
2 advance deposit wagering licensee if the organization licensee
3 discovers and the Board finds reputable or credible information
4 that the advance deposit wagering licensee is under
5 investigation by another state or federal governmental agency,
6 the advance deposit wagering licensee's license has been
7 suspended in another state, or the advance deposit wagering
8 licensee's license is in revocation proceedings in another
9 state. The organization licensee's provision of their live
10 signal to an advance deposit wagering licensee under this
11 subsection (g) pertains to wagers placed from within Illinois.
12 The costs"; and
 
13 on page 294, line 6, by replacing "date" with "effective date";
14 and
 
15 on page 349, line 19, by replacing "rule." with "rule. However,
16 the annual fees may not exceed $250,000 in any 4-year period.";
17 and
 
18 on page 352, by replacing line 17 with the following:
19 "described in Section 7.5. The additional riverboat license
20 authorizes the conduct of gambling in a municipality that is
21 economically depressed or that is sited in an economically
22 depressed primary census statistical area, or both; however,
23 the licensee must not conduct gambling pursuant to this license

1 within 15 miles from a licensed riverboat in operation on the
2 effective date of this amendatory Act of the 95th General
3 Assembly. In determining the water upon which the riverboat
4 authorized by the additional license will operate, the Board
5 shall minimize the reduction in privilege tax revenue received
6 by the State as a result of the impact of the additional
7 license on adjusted gross receipts generated by riverboat
8 gambling conducted by licenses in effect on the date of this
9 amendatory Act of the 95th General Assembly.
10     In determining the water upon which"; and
 
11 on page 353, line 1, by replacing "Illinois" with "Illinois;
12 however, the Board, in issuing the one additional riverboat
13 license authorized by this amendatory Act of the 95th General
14 Assembly, must give favorable consideration to these factors in
15 granting the owners license located in a municipality that is
16 economically depressed or that is sited in an economically
17 depressed primary census statistical area, or both."; and
 
18 on page 354, line 22 and line 26, by replacing "$50,000" each
19 time it appears with "$40,000"; and
 
20 on page 356, line 20, by replacing "$50,000" with "$40,000";
21 and
 
22 on page 367, line 19 and line 24, by replacing "$50,000" each

2 on page 368, line 6, by replacing "$50,000" with "$40,000"; and
 
3 on page 434, by replacing lines 4 through 18 with the

7 on page 434, line 24, after the period, by inserting "Thirty
8 percent of the moneys received from subsections (d) and (e) of
9 Section 13 shall be transferred into the Focusing on Children
10 Uplifting Schools (FOCUS) Fund.".
