AMENDMENT TO HOUSE BILL 2749

AMENDMENT NO. ______. Amend House Bill 2749 by replacing everything after the enacting clause with the following:

"Section 5. The Unified Code of Corrections is amended by adding Section 5-8A-2.5 as follows:

(730 ILCS 5/5-8A-2.5 new)

Sec. 5-8A-2.5. Counties of more than 3,000,000 inhabitants.

(a) In counties of more than 3,000,000 inhabitants, the Chief Judge of the Circuit Court shall be responsible for establishing procedures for the Circuit Court Judges under his or her authority to order pretrial and sentenced inmates into an electronic monitoring program run by the supervising authority. The judge currently presiding over the defendant's case shall make determinations of eligibility for and order transfer of inmates to such electronic monitoring program. The rules of eligibility and guidelines for determining non-compliance, as well as penalties for non-compliance, shall also be the responsibility of the Circuit Court.

(b) The supervising authority shall run the day to day monitoring operations and inform the Circuit Court as to the progress of detainees on the electronic monitoring program. The Chief Judge shall be responsible for coordinating with the county board, the supervising authority, and any other applicable authorities to ensure that the electronic monitoring program is being utilized by the Circuit Court to relieve overcrowding at the county jail.

Section 99. Effective date. This Act takes effect upon becoming law.".
