SYNOPSIS AS INTRODUCED:
 
20 ILCS 605/605-800   was 20 ILCS 605/46.19a in part

    Amends the Department of Commerce and Economic Opportunity Law concerning the program for training grants for skills in critical demand. Provides that each grant application must be accompanied with a certification signed and dated by the chief executive officer of the applicant or that officer's authorized representative certifying that all participating employees are Illinois residents and, for each participating employee, stating the employee's name and either (i) stating the employee's social security number or (ii) certifying that the applicant has adequately verified that the employee is an Illinois resident. Provides that the Department may audit the accuracy of applications.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Commerce and Economic
5 Opportunity Law of the Civil Administrative Code of Illinois is
6 amended by changing Section 605-800 as follows:
 
7     (20 ILCS 605/605-800)  (was 20 ILCS 605/46.19a in part)
8     Sec. 605-800. Training grants for skills in critical
9 demand.
10     (a) Grants to provide training in fields affected by
11 critical demands for certain skills may be made as provided in
12 this Section.
13     (b) The Director may make grants to eligible employers or
14 to other eligible entities on behalf of employers as authorized
15 in subsection (c) to provide training for employees in fields
16 for which there are critical demands for certain skills.
17     (c) The Director may accept applications for training grant
18 funds and grant requests from: (i) entities sponsoring
19 multi-company eligible employee training projects as defined
20 in subsection (d), including business associations, strategic
21 business partnerships, institutions of secondary or higher
22 education, large manufacturers for supplier network companies,
23 federal Job Training Partnership Act administrative entities

1 or grant recipients, and labor organizations when those
2 projects will address common training needs identified by
3 participating companies; and (ii) individual employers that
4 are undertaking eligible employee training projects as defined
5 in subsection (d), including intermediaries and training
6 agents. Each application must be accompanied with a
7 certification signed and dated by the chief executive officer
8 of the applicant or that officer's authorized representative
9 certifying that all participating employees are Illinois
10 residents and, for each participating employee, stating the
11 employee's name and either (i) stating the employee's social
12 security number or (ii) certifying that the applicant has
13 adequately verified that the employee is an Illinois resident.
14 The Department may audit the accuracy of applications.
15     (d) The Director may make grants to eligible applicants as
16 defined in subsection (c) for employee training projects that
17 include, but need not be limited to, one or more of the
18 following:
19         (1) Training programs in response to new or changing
20     technology being introduced in the workplace.
21         (2) Job-linked training that offers special skills for
22     career advancement or that is preparatory for, and leads
23     directly to, jobs with definite career potential and
24     long-term job security.
25         (3) Training necessary to implement total quality
26     management or improvement or both management and

1     improvement systems within the workplace.
2         (4) Training related to new machinery or equipment.
3         (5) Training of employees of companies that are
4     expanding into new markets or expanding exports from
5     Illinois.
6         (6) Basic, remedial, or both basic and remedial
7     training of employees as a prerequisite for other
8     vocational or technical skills training or as a condition
9     for sustained employment.
10         (7) Self-employment training of the unemployed and
11     underemployed with comprehensive, competency-based
12     instructional programs and services, entrepreneurial
13     education and training initiatives for youth and adult
14     learners in cooperation with the Illinois Institute for
15     Entrepreneurial Education, training and education,
16     conferences, workshops, and best practice information for
17     local program operators of entrepreneurial education and
18     self-employment training programs.
19         (8) Other training activities or projects, or both
20     training activities and projects, related to the support,
21     development, or evaluation of job training programs,
22     activities, and delivery systems, including training needs
23     assessment and design.
24     (e) Grants shall be made on the terms and conditions that
25 the Department shall determine. No grant made under subsection
26 (d), however, shall exceed 50% of the direct costs of all

1 approved training programs provided by the employer or the
2 employer's training agent or other entity as defined in
3 subsection (c). Under this Section, allowable costs include,
4 but are not limited to:
5         (1) Administrative costs of tracking, documenting,
6     reporting, and processing training funds or project costs.
7         (2) Curriculum development.
8         (3) Wages and fringe benefits of employees.
9         (4) Training materials, including scrap product costs.
10         (5) Trainee travel expenses.
11         (6) Instructor costs, including wages, fringe
12     benefits, tuition, and travel expenses.
13         (7) Rent, purchase, or lease of training equipment.
14         (8) Other usual and customary training costs.
15     (f) The Director will ensure that a minimum of one on-site
16 grant monitoring visit is conducted by the Department either
17 during the course of the grant period or within 6 months
18 following the end of the grant period. The Department shall
19 verify that the grantee's financial management system is
20 structured to provide for accurate, current, and complete
21 disclosure of the financial results of the grant program in
22 accordance with all provisions, terms, and conditions
23 contained in the grant contract.
24     (g) The Director may establish and collect a schedule of
25 charges from subgrantee entities and other system users under
26 federal job-training programs for participating in and

1 utilizing the Department's automated job-training program
2 information systems if the systems and the necessary
3 participation and utilization are requirements of the federal
4 job-training programs. All monies collected pursuant to this
5 subsection shall be deposited into the Title III Social
6 Security and Employment Fund, except that any moneys that may
7 be necessary to pay liabilities outstanding as of June 30, 2000
8 shall be deposited into the Federal Job-Training Information
9 Systems Revolving Fund.
