AMENDMENT TO HOUSE BILL 4646

2     AMENDMENT NO. ______. Amend House Bill 4646 on page 1, line
3 8, after "jointly" by inserting "with another unit of local
4 government, school district, or community college district
5 that is authorized to own and operate a wind generation turbine
6 farm"; and
 
7 on page 1, line 12, after "Opportunity", by inserting ", the
8 Illinois Power Agency,"; and
 
9 on page 1, line 20, after "jointly" by inserting "with another
10 unit of local government, school district, or community college
11 district that is authorized to own and operate a wind
12 generation turbine farm"; and
 
13 on page 2, line 2, after "Opportunity", by inserting ", the
14 Illinois Power Agency,"; and

1 on page 2, immediately below line 4, by inserting the
2 following:
 
3     "Section 15. The School Code is amended by changing and
4 renumbering Sections 10-20.40 and 34-18.34 as follows:
 
5     (105 ILCS 5/10-20.42)
6     Sec. 10-20.42 10-20.40. Wind farm. A school district may
7 own and operate a wind generation turbine farm, either
8 individually or jointly with a unit of local government, school
9 district, or community college district that is authorized to
10 own and operate a wind generation turbine farm, that directly
11 or indirectly reduces the energy or other operating costs of
12 the school district. The school district may ask for the
13 assistance of any State agency, including without limitation
14 the State Board of Education, the Illinois Power Agency, or the
15 Environmental Protection Agency, in obtaining financing
16 options for a wind generation turbine farm.

8     Section 20. The Public Community College Act is amended by
9 changing Section 3-42.3 as follows:
 
10     (110 ILCS 805/3-42.3)
11     Sec. 3-42.3. Wind farm. To own and operate a wind
12 generation turbine farm, either individually or jointly with a
13 unit of local government, school district, or community college
14 district that is authorized to own and operate a wind
15 generation turbine farm, that directly or indirectly reduces
16 the energy or other operating costs of the community college
17 district. The board may ask for the assistance of any State
18 agency, including without limitation the State Board, the
19 Illinois Power Agency, or the Environmental Protection Agency,
20 in obtaining financing options for a wind generation turbine
21 farm.
