AMENDMENT TO HOUSE BILL 4803

2     AMENDMENT NO. ______. Amend House Bill 4803 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Renewable Fuels Development
5 Program Act is amended by changing Section 15 as follows:
 
6     (20 ILCS 689/15)
7     Sec. 15. Illinois Renewable Fuels Development Program.
8     (a) The Department must develop and administer the Illinois
9 Renewable Fuels Development Program to assist in the
10 construction, modification, alteration, or retrofitting of
11 renewable fuel plants in Illinois. The recipient of a grant
12 under this Section must:
13         (1) be constructing, modifying, altering, or
14     retrofitting a plant in the State of Illinois;
15         (2) be constructing, modifying, altering, or
16     retrofitting a plant that has annual production capacity of

1     no less than 30,000,000 gallons of renewable fuel per year;
2     and
3         (3) enter into a project labor agreement as prescribed
4     by Section 25 of this Act; .
5         (4) have received all construction permits required
6     for the project by the Environmental Protection Agency; and
7         (5) provide a documented water supply, treatment, and
8     discharge plan for the plant's operations, including:
9                 (i) proposed and alternative source water
10             characterization including water quality,
11             quantity, and biota of the sources;
12                 (ii) proposed average daily and maximum annual
13             water needs of the proposed project;
14                 (iii) a demonstration that the proposed water
15             withdrawals will not jeopardize the reliability of
16             existing uses or natural conditions of the same
17             source waters, or other waters that are dependent
18             on flows from the source waters;
19                 (iv) a characterization of the proposed
20             wastewater discharge from the plant, including
21             water quality and quantity with consideration of
22             potential for erosion or habitat destruction in
23             the receiving stream;
24                 (v) a demonstration that the plant will employ
25             Best Available Technology (BAT) for water
26             conservation, including options for potential

1             reuse of the plant's wastewater;
2                 (vi) a characterization of the plant's
3             wastewater treatment and monitoring practices,
4             including both process water and stormwater;
5                 (vii) a characterization of the waters that
6             will receive the wastewater and stormwater
7             discharges from the plant, including their
8             quality, quantity, and existing biota; and
9                  (viii) demonstration of a system for
10             monitoring of total trihalomethanes (TTHMs) and
11             haloacetic acids (HAAs) if the applicant proposes
12             to use chlorine as a biocide in the cooling water.
13     (b) Grant applications must be made on forms provided by
14 and in accordance with procedures established by the
15 Department.
16     (c) The Department must give preference to applicants that
17 use Illinois agricultural products in the production of
18 renewable fuel at the plant for which the grant is being
19 requested.
