1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Central Management Services
5 Law of the Civil Administrative Code of Illinois is amended by
6 adding Section 405-216 as follows:
 
7     (20 ILCS 405/405-216 new)
8     Sec. 405-216. Green cleaning policy. To require every
9 State-owned building to establish a green cleaning policy
10 whereby the building purchases and uses only
11 environmentally-sensitive cleaning products, in compliance
12 with the guidelines and specifications established by the
13 Illinois Green Government Coordinating Council pursuant to
14 Section 15 of the Green Cleaning Schools Act. The Department
15 shall allow a State-owned building to deplete its existing
16 cleaning and maintenance supply stocks and implement the new
17 requirements in the procurement cycle for the following year
18 and shall exempt a State-owned building from the green cleaning
19 policy requirement if adhering to the requirement would not be
20 economically feasible for the building.
21     For the purposes of this Section, adopting a green cleaning
22 policy is not economically feasible if such adoption would
23 result in an increase in the cleaning costs of the building.

1     Notwithstanding any other rulemaking authority that may
2 exist, neither the Governor nor any agency or agency head under
3 the jurisdiction of the Governor has any authority to make or
4 promulgate rules to implement or enforce the provisions of this
5 amendatory Act of the 95th General Assembly. If, however, the
6 Governor believes that rules are necessary to implement or
7 enforce the provisions of this amendatory Act of the 95th
8 General Assembly, the Governor may suggest rules to the General
9 Assembly by filing them with the Clerk of the House and the
10 Secretary of the Senate and by requesting that the General
11 Assembly authorize such rulemaking by law, enact those
12 suggested rules into law, or take any other appropriate action
13 in the General Assembly's discretion. Nothing contained in this
14 amendatory Act of the 95th General Assembly shall be
15 interpreted to grant rulemaking authority under any other
16 Illinois statute where such authority is not otherwise
17 explicitly given. For the purposes of this amendatory Act of
18 the 95th General Assembly, "rules" is given the meaning
19 contained in Section 1-70 of the Illinois Administrative
20 Procedure Act, and "agency" and "agency head" are given the
21 meanings contained in Sections 1-20 and 1-25 of the Illinois
22 Administrative Procedure Act to the extent that such
23 definitions apply to agencies or agency heads under the
24 jurisdiction of the Governor.
 
25     Section 10. The Green Cleaning Schools Act is amended by

1 changing Sections 5 and 15 as follows:
 
2     (105 ILCS 140/5)
3     Sec. 5. Legislative findings. Both children and adults
4 Children are vulnerable to and may be severely affected by
5 exposure to chemicals, hazardous waste, and other
6 environmental hazards. The Federal Environmental Protection
7 Agency estimates that human exposure to indoor air pollutants
8 can be 2 to 5 times and up to 100 times higher than outdoor
9 levels. Children, workers, teachers, janitors, and other staff
10 members spend a significant amount of time inside school and
11 other institutional buildings and are continuously exposed to
12 chemicals from cleaners, waxes, deodorizers, and other
13 maintenance products.

16     Sec. 15. Green cleaning supply guidelines and
17 specifications. The Illinois Green Government Coordinating
18 Council (IGGCC) shall, in consultation with the Department of
19 Public Health, the State Board of Education, regional offices
20 of education, the Illinois Environmental Protection Agency,
21 and a panel of interested stakeholders, including cleaning
22 product industry representatives, non-governmental
23 organizations, and others, establish and amend on an annual
24 basis guidelines and specifications for

1 environmentally-sensitive cleaning and maintenance products
2 for use in school facilities as well as State-owned buildings
3 under Section 405-216 of the Department of Central Management
4 Services Law of the Civil Administrative Code of Illinois. The
5 IGGCC shall provide multiple avenues by which cleaning products
6 may be determined to be environmentally-sensitive under the
7 guidelines. Guidelines and specifications must be established
8 after a review and evaluation of existing research and must be
9 completed no later than 180 days after the effective date of
10 this Act. Guidelines and specifications may include
11 implementation practices, including inspection. The completed
12 guidelines and specifications must be posted on the IGGCC's
13 Internet website.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
