AMENDMENT TO HOUSE BILL 4964

2     AMENDMENT NO. ______. Amend House Bill 4964 by replacing
3 lines 25 and 26 on page 9, all of page 10, and line 1 on page 11
4 with the following:
5     "(o) With prior written notification to the State's
6 Attorney or his or her designee of the county in which the
7 conversation is anticipated to occur, recording or listening
8 with the aid of an eavesdropping device to a conversation in
9 which a law enforcement officer, or any person acting at the
10 direction of a law enforcement officer, is a party to an
11 undercover conversation and has consented to the conversation
12 being intercepted or recorded in the course of an investigation
13 of a felony violation of the Illinois Controlled Substances
14 Act, a felony violation of the Cannabis Control Act, or a
15 felony violation of the Methamphetamine Control and Community
16 Protection Act. Whenever any wire, electronic, or oral
17 communication has been intercepted as a result of this
18 exception that is not related to felony violations of the

1 Illinois Controlled Substances Act, felony violations of the
2 Cannabis Control Act, or felony violations of the
3 Methamphetamine Control and Community Protection Act and
4 conspiracies related thereto, no part of the contents of the
5 communication and no evidence derived therefrom may be received
6 in evidence in any trial, hearing, or other proceeding in or
7 before any court, grand jury, department, officer, agency,
8 regulatory body, legislative committee, or other authority of
9 this State, or a political subdivision thereof, if the
10 disclosure of that information would be in violation of this
11 subtitle unless the violation involves a forcible felony.
12 Furthermore, the Director of the State Police shall issue rules
13 as are necessary concerning the use of devices, review of
14 recordings, notice to parties, retention of recording media,
15 and reports regarding their use; and".
