| AMENDMENT TO HOUSE BILL 5006

| AMENDMENT NO. ______. Amend House Bill 5006, AS AMENDED, by | 3 |
| replacing everything after the enacting clause with the | 4 |
| following:

| "Section 5. The Illinois Vehicle Code is amended by | 6 |
| changing Section 11-1426.1 as follows: | 7 |
| (625 ILCS 5/11-1426.1) | 8 |
| Sec. 11-1426.1. Operation of neighborhood vehicles on | 9 |
| streets, roads, and highways , and roadways . | 10 |
| (a) As used in this Section, "neighborhood vehicle" means a | 11 |
| self-propelled, electronically powered four-wheeled motor | 12 |
| vehicle (or a self-propelled, gasoline-powered four-wheeled | 13 |
| motor vehicle with an engine displacement under 1,200 cubic | 14 |
| centimeters) which is capable of attaining in one mile a speed | 15 |
| of more than 20 miles per hour, but not more than 25 miles per | 16 |
| hour, and which conforms to federal regulations under Title 49 |

| (b) Except as otherwise provided in this Section, it is | 3 |
| unlawful
for any person to drive or operate a neighborhood | 4 |
| vehicle
upon any street, highway, or roadway in this State. If | 5 |
| the operation of a neighborhood vehicle is authorized under | 6 |
| subsection (d), the neighborhood vehicle may be operated only | 7 |
| on streets , highways, or roadways where the posted speed limit | 8 |
| is 35 miles per hour or less. This subsection (b) does not | 9 |
| prohibit a neighborhood vehicle from crossing a road or street , | 10 |
| highway, or roadway at an intersection where the road or | 11 |
| street , highway, or roadway has a posted speed limit of more | 12 |
| than 35 miles per hour. | 13 |
| (b-5) A person may not operate a neighborhood vehicle upon | 14 |
| any street, highway, or roadway in this State unless he or she | 15 |
| has a valid Illinois driver's license issued in his or her name | 16 |
| by the Secretary of State. | 17 |
| (c) No Except as otherwise provided in subsection (c-5), no | 18 |
| person operating a neighborhood vehicle shall make a direct | 19 |
| crossing upon or across any freeway highway under the | 20 |
| jurisdiction of the State , tollroad, or
interstate highway , or | 21 |
| controlled access highway in this State. | 22 |
| (c-5) (Blank) A person may make a direct crossing at an | 23 |
| intersection controlled by a traffic light or 4-way stop sign | 24 |
| upon or across a highway under the jurisdiction of the State if | 25 |
| the speed limit on the highway is 35 miles per hour or less at | 26 |
| the place of crossing . |

| (d) A municipality, township, county, or other unit of | 2 |
| local government may authorize, by ordinance or resolution, the | 3 |
| operation of neighborhood vehicles on streets, highways, or | 4 |
| roadways under its jurisdiction if the unit of local government | 5 |
| determines that the public safety will not be jeopardized. The | 6 |
| Department may authorize
the operation of neighborhood | 7 |
| vehicles on the streets, highways, or roadways under its | 8 |
| jurisdiction if the Department determines that the public | 9 |
| safety will not be jeopardized. | 10 |
| Before permitting the operation of neighborhood vehicles | 11 |
| on its streets, highways, or roadways,
a municipality, | 12 |
| township, county, other unit of local government, or the | 13 |
| Department must consider the volume, speed, and character of | 14 |
| traffic on the street, highway, or roadway and determine | 15 |
| whether neighborhood vehicles may safely travel on or cross the | 16 |
| street, highway, or roadway. Upon determining that | 17 |
| neighborhood vehicles may safely operate on a street, highway, | 18 |
| or roadway and the adoption of an ordinance or resolution by a | 19 |
| municipality, township, county, or other unit of local | 20 |
| government, or authorization by the Department, appropriate | 21 |
| signs shall be posted. | 22 |
| If a street, highway, or roadway is under the jurisdiction | 23 |
| of more than one unit of government, neighborhood vehicles may | 24 |
| not be operated on the street, highway, or roadway unless each
| 25 |
| unit of government agrees and takes action as provided in this | 26 |
| subsection. |

| (e) No neighborhood vehicle may be operated on a street, | 2 |
| highway, or roadway unless, at a minimum, it has
the following: | 3 |
| brakes, a steering apparatus, tires, a rearview mirror, red | 4 |
| reflectorized warning devices in the front and rear, a slow | 5 |
| moving emblem (as required of other vehicles in Section 12-709 | 6 |
| of this Code) on the rear of the neighborhood vehicle, a | 7 |
| headlight that emits a white light visible from a distance of | 8 |
| 500 feet to the front, a tail lamp that emits a
red light | 9 |
| visible from at least 100 feet from the rear, brake lights, and | 10 |
| turn signals. When operated on a street, highway, or roadway, a | 11 |
| neighborhood vehicle shall have its headlight and tail lamps | 12 |
| lighted as required by Section 12-201 of this Code. | 13 |
| (f) A person who drives or is in actual physical control of | 14 |
| a neighborhood vehicle on a street, highway, or roadway while | 15 |
| under the influence is subject to Sections 11-500 through | 16 |
| 11-502 of this Code.
