SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-704.3 new

    Amends the Illinois Vehicle Code. Provides that the owner of any vehicle alleged to have been in a motor vehicle accident resulting in injury to or death of any person or damage to any vehicle or property, whether driven, attended, or unattended by any person, where the driver of the vehicle did not stop and report the accident, shall, upon appropriate demand by the State's Attorney or other designated person acting in response to a signed complaint, provide a written statement or deposition identifying the operator of the vehicle if such operator was not the owner at the time of the alleged violation. Provides for a 3-month suspension of the vehicle registration for failure to provide the written statement or deposition. Provides that, in the event the owner has assigned control for the use of the vehicle to another, the person to whom control was assigned shall provide a written statement or deposition identifying the operator of the vehicle.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by adding
5 Section 3-704.3 as follows:
 
6     (625 ILCS 5/3-704.3 new)
7     Sec. 3-704.3. Failure to stop; registration suspension.
8 The owner of any vehicle alleged to have been in a motor
9 vehicle accident in which the driver of the motor vehicle was
10 in violation of Section 11-401, 11-402, or 11-404, shall, upon
11 appropriate demand by the State's Attorney or other designated
12 person acting in response to a signed complaint, provide a
13 written statement or deposition identifying the operator of the
14 vehicle if such operator was not the owner at the time of the
15 alleged violation. Failure to supply such information shall
16 result in the suspension of the vehicle registration of the
17 vehicle for a period of 3 months. In the event the owner has
18 assigned control for the use of the vehicle to another, the
19 person to whom control was assigned shall comply with the
20 provisions of this Section and be subject to the same penalties
21 as herein provided.
