AMENDMENT TO HOUSE BILL 5189

2     AMENDMENT NO. ______. Amend House Bill 5189, on page 33, by
3 replacing lines 21 through 25 with the following:
 
4 "covenants, rules, regulations or bylaws. However, nothing in
5 this Act or the declarations, bylaws, rules and regulations of
6 an association that currently permits leasing or of an
7 association incorporated after the effective date of this
8 amendatory Act of the 95th General Assembly, shall prohibit the
9 unit owners from leasing up to 20% of the units, as long as the
10 unit owners otherwise comply with the provisions of this Act.";
11 and
 
12 on page 37, by replacing lines 17 through 21 with the
13 following:
 
14 "to the front-door area of a condominium unit. However, for
15 associations incorporated after the effective date of this

1 amendatory Act of the 95th General Assembly, and for
2 associations that currently permit leasing, no declarations,
3 by-laws, rules or regulations, or other condominium
4 instruments shall prohibit the unit owners from leasing up to
5 20% of the total units, as long as the unit owners otherwise
6 comply with the provisions of this Act."; and
 
7 on page 41, by replacing lines 4 through 11 with the following:
 
8     "(a) For a common interest community or homeowners'
9 association incorporated after the effective date of this
10 amendatory Act of the 95th General Assembly, and for a common
11 interest community or homeowners' association that currently
12 permits leasing, notwithstanding any other provision in the
13 common interest community's or homeowners' association's
14 declaration, covenants, bylaws, rules, regulations, or other
15 instruments or any construction of those instruments by a
16 common interest community's or homeowners' association's board
17 of directors, a homeowners' association or common interest
18 community incorporated under this Act may not prohibit 20% of
19 the total units from being used as leasing property.".
