|
Amends the Election Code. Provides that an otherwise qualified person who has returned from service with the United States armed forces, merchant marines, or the federal government outside the United States within 30 days before an election may register to vote up to 5 days before that election. Permits the same registration for the otherwise qualified spouse and dependents living with or accompanying the member of the armed forces or the merchant marine. Extends grace period voting until the 5th day before an election or primary for those voters only.

| AN ACT concerning elections.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Election Code is amended by changing | 5 |
| Sections 3-1, 4-50, 5-50, and 6-100 as follows:
| 6 |
| (10 ILCS 5/3-1) (from Ch. 46, par. 3-1)

| Sec. 3-1. Every person (i) who has resided in this State | 8 |
| and in the
election district 30 days next preceding any | 9 |
| election therein, or (ii) who
has resided in and is registered | 10 |
| to vote from the election district 30 days
next preceding any | 11 |
| election therein and has moved to another election district
in | 12 |
| this State within said 30 days and has made and subscribed to | 13 |
| the affidavit
provided in paragraph (b) of Section 17-10 of | 14 |
| this Act, or (iii) who has
resided in and is registered to vote | 15 |
| from the election district 30 days next
preceding any election | 16 |
| therein and has not moved to another residence but whose
| 17 |
| address has changed as a result of implementation of a 9-1-1 | 18 |
| emergency
telephone system and has made and subscribed to the | 19 |
| affidavit provided in
subsection (a) of Section 17-10, or (iv) | 20 |
| who has resided in this State and in the election district | 21 |
| fewer than 30 days next preceding any election therein but who | 22 |
| was a member of the United States service, as defined in | 23 |
| Section 20-1, within 30 days next preceding that election and |

| who
is a citizen of the United States, of the age of 18 or more | 2 |
| years is
entitled to vote at such election for all offices and | 3 |
| on all
propositions ; provided that a person described in item | 4 |
| (iv) must register to vote in accordance with Section 4-50, | 5 |
| 5-50, or 6-100 . Any military establishment within the | 6 |
| boundaries of
Illinois is "in this State" even though the | 7 |
| government of the United
States may have exclusive jurisdiction | 8 |
| over such establishment.

| Sec. 4-50. Grace period. Notwithstanding any other | 12 |
| provision of this
Code to the contrary, each election authority | 13 |
| shall
establish procedures for the registration of voters and | 14 |
| for change of address during the period from the close of
| 15 |
| registration for a primary or election and until (i) the 14th | 16 |
| day before the
primary or election and (ii) for persons | 17 |
| described in item (iv) of Section 3-1, the 5th day before the | 18 |
| primary or election . During this grace period, an unregistered | 19 |
| qualified
elector may
register to vote, and until the 14th day | 20 |
| before the primary or election a registered voter may submit a | 21 |
| change of address form, in person in the office of the election
| 22 |
| authority or at a voter registration location specifically | 23 |
| designated for this
purpose by the election authority. The | 24 |
| election authority shall
register that individual, or change a | 25 |
| registered voter's address, in the same manner as otherwise |

| If a voter who registers or changes address during this | 4 |
| grace period wishes to vote at the first election or primary | 5 |
| occurring after the grace period, he or she must do so by grace | 6 |
| period voting, either in person in the office of the election | 7 |
| authority or at a location specifically designated for this | 8 |
| purpose by the election authority, or by mail, at the | 9 |
| discretion of the election authority. Grace period voting shall | 10 |
| be in a manner substantially similar to voting under Article | 11 |
| 19. | 12 |
| Within one day after a voter casts a grace period ballot, | 13 |
| the election authority shall transmit the voter's name, street | 14 |
| address, and precinct, ward, township, and district numbers, as | 15 |
| the case may be, to the State Board of Elections, which shall | 16 |
| maintain those names and that information in an electronic | 17 |
| format on its website, arranged by county and accessible to | 18 |
| State and local political committees. The name of each person | 19 |
| issued a grace period ballot shall also be placed on the | 20 |
| appropriate precinct list of persons to whom absentee and early | 21 |
| ballots have been issued, for use as provided in Sections 17-9 | 22 |
| and 18-5. | 23 |
| A person who casts a grace period ballot shall not be | 24 |
| permitted to revoke that ballot and vote another ballot with | 25 |
| respect to that primary or election. Ballots cast by persons | 26 |
| who register or change address during the grace period must be |
