Amends the Barber, Cosmetology, Esthetics, and Nail
Technology Act of 1985. Changes the date after which the Department of Financial and Professional Regulation will not issue any new cosmetology clinic teacher, esthetic clinic teacher, or nail technology clinic teacher licenses from January 1, 2009 to January 1, 2011. Allows for the renewal and restoration of these clinic teacher licenses initially issued before January 1, 2011 (instead of January 1, 2009).

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Barber, Cosmetology, Esthetics, and Nail
| 5 |
| Technology Act of 1985 is amended by changing Sections 3-4, | 6 |
| 3A-3, and 3C-3 as follows:
| 7 |
| (225 ILCS 410/3-4) (from Ch. 111, par. 1703-4)

| (Section scheduled to be repealed on January 1, 2016)
| 9 |
| Sec. 3-4. Licensure as cosmetology
teacher or cosmetology | 10 |
| clinic teacher; qualifications.
| 11 |
| (a) A person is qualified to receive license as a | 12 |
| cosmetology teacher
if that person has
applied in writing on | 13 |
| forms provided by the Department, has paid the required
fees, | 14 |
| and:
| 15 |
| (1) is at least 18 years of age;
| 16 |
| (2) has graduated from high school or its equivalent;
| 17 |
| (3) has a current license as a cosmetologist;
| 18 |
| (4) has either: (i) completed a program of 500 hours of | 19 |
| teacher
training in
a licensed school of cosmetology and | 20 |
| had 2 years of practical
experience as a licensed | 21 |
| cosmetologist within 5 years
preceding the examination; or | 22 |
| (ii) completed a program of 1,000 hours of
teacher training | 23 |
| in
a
licensed school of cosmetology;

| (5) has passed an examination authorized by the | 2 |
| Department to
determine eligibility to receive a license as | 3 |
| a cosmetology teacher; and
| 4 |
| (6) has met any other requirements of this Act.

| An individual who receives a license as a cosmetology | 6 |
| teacher shall not be
required to maintain an active cosmetology | 7 |
| license in order to practice
cosmetology as defined in this | 8 |
| Act.
| 9 |
| (b) A person is qualified to receive a license as a | 10 |
| cosmetology clinic
teacher if he or she has applied in writing | 11 |
| on forms provided by the
Department, has paid the required | 12 |
| fees, and:
| 13 |
| (1) is at least 18 years of age;
| 14 |
| (2) has graduated from high school or its equivalent;
| 15 |
| (3) has a current license as a cosmetologist;
| 16 |
| (4) has (i) completed a program of 250 hours of clinic | 17 |
| teacher training in
a licensed
school of cosmetology or | 18 |
| (ii) within 5 years preceding the examination, has obtained | 19 |
| a minimum of 2 years of practical experience working at | 20 |
| least 30 full-time hours per week as a licensed
| 21 |
| cosmetologist and has completed an instructor's institute | 22 |
| of 20 hours, as prescribed by the Department, prior to | 23 |
| submitting an application for examination;
| 24 |
| (5) has passed an examination authorized by the | 25 |
| Department to determine
eligibility to receive a license as | 26 |
| a cosmetology teacher; and

has met any other requirements of this Act.

| The Department shall not issue any new cosmetology clinic | 3 |
| teacher licenses after January 1, 2011 2009 . Any person issued | 4 |
| a license as a cosmetology clinic teacher before January 1, | 5 |
| 2011 2009 , may renew the license after that date under this Act | 6 |
| and that person may continue to renew the license or have the | 7 |
| license restored during his or her lifetime, subject only to | 8 |
| the renewal or restoration requirements for the license under | 9 |
| this Act; however, such licensee and license shall remain | 10 |
| subject to the provisions of this Act, including, but not | 11 |
| limited to, provisions concerning renewal, restoration, fees, | 12 |
| continuing education, discipline, administration, and | 13 |
| enforcement.

| qualifications.
| 19 |
| (a) A person is qualified to receive a license as an | 20 |
| esthetics teacher
if
that person has applied in writing on | 21 |
| forms supplied by the Department, paid
the required fees,
and:
| 22 |
| (1) is at least 18 years of age;
| 23 |
| (2) has graduated from high school or its equivalent;
| 24 |
| (3) has a current license as a
licensed cosmetologist | 25 |
| or esthetician;

| (4) has either: (i) completed a program of 500 hours of
| 2 |
| teacher training in a
licensed school of cosmetology or a | 3 |
| licensed esthetics
school and had 2 years of practical | 4 |
| experience as a licensed cosmetologist or
esthetician | 5 |
| within 5 years preceding the
examination; or (ii) completed | 6 |
| a program of 750 hours of teacher training
in a
licensed | 7 |
| school of cosmetology approved by the Department to teach
| 8 |
| esthetics or a licensed esthetics school;
| 9 |
| (5) has passed an examination authorized by the | 10 |
| Department to
determine eligibility to receive a license as | 11 |
| a
licensed cosmetology or esthetics teacher;
| 12 |
| (6) (blank); and
| 13 |
| (7) has met any other requirements as required by this | 14 |
| Act.
| 15 |
| (b) A person is qualified to receive a license as an | 16 |
| esthetics clinic
teacher if that person has applied in writing | 17 |
| on forms supplied by the
Department, paid the required fees, | 18 |
| and:
| 19 |
| (1) is at least 18 years of age;
| 20 |
| (2) has graduated from high school or its equivalent;
| 21 |
| (3) has a current license as a licensed cosmetologist | 22 |
| or esthetician;
| 23 |
| (4) has (i) completed a program of 250 hours of clinic | 24 |
| teacher training in
a licensed
school of cosmetology | 25 |
| approved by the Department to teach esthetics or a
licensed
| 26 |
| esthetics school or (ii) within 5 years preceding the |

| examination, has obtained a minimum of 2 years of practical | 2 |
| experience working at least 30 full-time hours per week as | 3 |
| a licensed
cosmetologist or esthetician and has completed | 4 |
| an instructor's institute of 20 hours, as prescribed by the | 5 |
| Department, prior to submitting an application for | 6 |
| examination;
| 7 |
| (5) has passed an examination authorized by the | 8 |
| Department to determine
eligibility to receive a license as | 9 |
| a licensed cosmetology teacher or
licensed
esthetics | 10 |
| teacher;
| 11 |
| (6)
(blank); and
| 12 |
| (7) has met any other requirements required by this | 13 |
| Act.
| 14 |
| The Department shall not issue any new esthetics clinic | 15 |
| teacher licenses after January 1, 2011 2009 . Any person issued | 16 |
| a license as an esthetics clinic teacher before January 1, 2011 | 17 |
| 2009 , may renew the license after that date under this Act and | 18 |
| that person may continue to renew the license or have the | 19 |
| license restored during his or her lifetime, subject only to | 20 |

| an esthetics license in
order to practice as an esthetician as | 3 |
| defined in this Act.

| Sec. 3C-3. Licensure as a nail technology teacher or nail | 8 |
| technology
clinic teacher; qualifications.
| 9 |
| (a) A person
is qualified to receive a license as a nail | 10 |
| technology teacher if that person
has filed an application on | 11 |
| forms provided by the Department, paid the required
fee, and:
| 12 |
| (1) is at least 18 years of age;
| 13 |
| (2) has graduated from high school or its equivalent;
| 14 |
| (3) has a current license as a cosmetologist or nail
| 15 |
| technician;
| 16 |
| (4) has either: (1) completed a program of 500 hours of | 17 |
| teacher
training
in a
licensed school of nail technology or | 18 |
| cosmetology, and had 2 years of practical
experience as a | 19 |
| nail
technician; or (2) has completed a program of 625 | 20 |
| hours of teacher training
in
a licensed school of | 21 |
| cosmetology approved to teach nail
technology or school of | 22 |
| nail technology; and
| 23 |
| (5) who has passed an examination authorized by the
| 24 |
| Department
to determine eligibility to receive a license as | 25 |
| a cosmetology or nail technology
teacher.

| (b) A person is qualified to receive a license as a nail | 2 |
| technology clinic
teacher if that person has applied in writing | 3 |
| on forms supplied by the
Department, paid the required fees, | 4 |
| and:
| 5 |
| (1) is at least 18 years of age;
| 6 |
| (2) has graduated from high school or its equivalent;
| 7 |
| (3) has a current license as a licensed cosmetologist | 8 |
| or nail technician;
| 9 |
| (4) has (i) completed a program of 250 hours of clinic | 10 |
| teacher training in
a licensed
school of cosmetology or a | 11 |
| licensed nail technology school or (ii) within 5 years | 12 |
| preceding the examination, has obtained a minimum of 2 | 13 |
| years of
practical experience working at least 30 full-time | 14 |
| hours per week as a licensed
cosmetologist or nail | 15 |
| technician and has completed an instructor's institute of | 16 |
| 20 hours, as prescribed by the Department, prior to | 17 |
| submitting an application for examination;
| 18 |
| (5) has passed an examination authorized by the | 19 |
| Department to determine
eligibility to receive a license as | 20 |
| a licensed cosmetology teacher or
licensed
nail technology | 21 |
| teacher;
| 22 |
| (6) demonstrates, to the satisfaction of the | 23 |
| Department, current skills in
the use of machines used in | 24 |
| the practice of nail technology; and
| 25 |
| (7)
has met any other requirements required by this | 26 |
| Act.

| The Department shall not issue any new nail technology | 2 |

| (c) An applicant who receives a license as a nail | 14 |
| technology teacher
or nail technology clinic teacher shall not | 15 |
| be required to maintain a
license as a nail technician.
