1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Flag Display Act is amended by changing
5 Section 10 as follows:
 
6     (5 ILCS 465/10)
7     Sec. 10. Death of resident military member, or law
8 enforcement officer, or firefighter.
9     (a) The Governor shall issue an official notice to fly the
10 following flags at half-staff upon the death of a resident of
11 this State killed (i) by hostile fire as a member of the United
12 States armed forces, or (ii) in the line of duty as a law
13 enforcement officer, or (iii) in the line of duty as a
14 firefighter: the United States national flag, the State flag of
15 Illinois, and, in the case of the death of the member of the
16 United States armed forces, the appropriate military flag as
17 defined in subsection (b) of Section 18.6 of the Condominium
18 Property Act. Upon the Governor's notice, each person or entity
19 required by this Act to ensure the display of the United States
20 national flag on a flagstaff shall ensure that the flags
21 described in the notice are displayed at half-staff on the day
22 designated for the resident's funeral and the 2 days preceding
23 that day.

1     (b) The Department of Veterans' Affairs shall notify the
2 Governor of the death by hostile fire of an Illinois resident
3 member of the United States armed forces. The Department of
4 State Police shall notify the Governor of the death in the line
5 of duty of an Illinois resident law enforcement officer. The
6 Office of the State Fire Marshal shall notify the Governor of
7 the death in the line of duty of an Illinois resident
8 firefighter. Notice to the Governor shall include at least the
9 resident's name and Illinois address, the date designated for
10 the funeral, and the circumstances of the death.
11     (c) For the purpose of this Section, the United States
12 armed forces includes: (i) the United States Army, Navy, Marine
13 Corps, Air Force, and Coast Guard; (ii) any reserve component
14 of each of the forces listed in item (i); and (iii) the
15 National Guard.
16     (d) Nothing in this Section requires the removal or
17 relocation of any existing flags currently displayed in the
18 State. This Section does not apply to a State facility if the
19 requirements of this Section cannot be satisfied without a
20 physical modification to that facility.

22     Section 99. Effective date. This Act takes effect upon
23 becoming law.
