AMENDMENT TO HOUSE BILL 162

2     AMENDMENT NO. ______. Amend House Bill 162 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Cycle Rider Safety Training Act is amended
5 by changing Sections 2.03, 2.04, 3, 4, 5, 6, and 7 and by
6 adding Section 6.2 as follows:
 
7     (625 ILCS 35/2.03)  (from Ch. 95 1/2, par. 802.03)
8     Sec. 2.03. "Cycle Rider Safety Training Courses" and
9 "Courses" mean courses of instruction in the use and operation
10 of cycles, including instruction in the safe on-road operation
11 of cycles, the rules of the road and the laws of this State
12 relating to motor vehicles, which courses meet the minimum
13 requirements of this Act and the rules and regulations issued
14 hereunder by the Secretary Department and which have been
15 approved by the Secretary Department as meeting such
16 requirements.

3     Sec. 2.04. "Secretary" "Department" means the Secretary of
4 State Illinois Department of Transportation.

7     Sec. 3. The Secretary Department shall have the power, duty
8 and authority to administer this Act.

11     Sec. 4. Any State or community college, State university or
12 community agency designated by the Secretary Department may
13 organize a Regional Cycle Rider Safety Training Center and may
14 offer cycle rider safety training courses through such Training
15 Centers which it operates. The curriculum and accreditation for
16 the courses, and the geographic areas in which each Training
17 Center may offer the courses, shall be provided for by rules
18 and regulations of the Secretary Department. Instructors of
19 such courses shall meet the qualification and certification
20 requirements of the regulations of the Secretary Department and
21 the college, university or community agency offering the
22 program and may be employed on a calendar year rather than a
23 school year basis. Such courses shall be open to all residents

1 of the State who hold a currently valid driver's license and
2 who have reached their 16th birthday without regard to whether
3 such person is enrolled in any other course offered by said
4 State or community college, State university or community
5 agency. Such courses may be offered throughout the calendar
6 year. The courses may be offered as credit or noncredit
7 courses, but no fee shall be charged except for a nominal
8 registration fee which shall be refunded upon completion of the
9 course.

12     Sec. 5. The Secretary Department may promulgate rules and
13 regulations not inconsistent with the provisions of the Cycle
14 Rider Safety Training Act for the administration of the Cycle
15 Rider Safety Training Act.

18     Sec. 6. To finance the Cycle Rider Safety Training program
19 and to pay the costs thereof, the Secretary of State will
20 hereafter deposit with the State Treasurer an amount equal to
21 each annual fee and each reduced fee, for the registration of
22 each motorcycle, motor driven cycle and moped processed by the
23 Office of the Secretary of State during the preceding quarter
24 as required in subsection (d) of Section 2-119 of the Illinois

1 Vehicle Code, which amount the State Comptroller shall transfer
2 quarterly to a trust fund outside of the State treasury to be
3 known as the Cycle Rider Safety Training Fund, which is hereby
4 created. In addition, the Secretary Department may accept any
5 federal, State, or private moneys for deposit into the Fund and
6 shall be used by the Secretary Department only for the expenses
7 of the Secretary Department in administering the provisions of
8 this Act, for funding of contracts with approved Regional Cycle
9 Rider Safety Training Centers for the conduct of courses, or
10 for any purpose related or incident thereto and connected
11 therewith.

13     (625 ILCS 35/6.2 new)
14     Sec. 6.2. The trustee of the Cycle Rider Safety Training
15 Fund:
16     (a) shall be the Secretary of State;
17     (b) has a fiduciary duty to all motorcyclists of the State
18 of Illinois to make maximum, efficient use of the Cycle Rider
19 Safety Training Fund to fund motorcycle safety training in
20 Illinois; and
21     (c) shall transfer money from that Fund to approved
22 motorcycle safety programs in this State without further
23 authorization from any governmental official or body.

1     Sec. 7. The Secretary Department is authorized to and shall
2 award contracts out of money in appropriations to the
3 Department from "The Cycle Rider Safety Training Fund" to
4 qualifying Regional Cycle Rider Safety Training Centers for the
5 conduct of approved Cycle Rider Safety Training courses.

7     Section 99. Effective date. This Act takes effect upon
8 becoming law.".
