| AN ACT concerning education.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The School Code is amended by changing Section | 5 |
| 10-17a and by adding Sections 10-20.46 and 34-18.37 as follows:

| (105 ILCS 5/10-17a) (from Ch. 122, par. 10-17a)

| Sec. 10-17a. Better schools accountability.
| 8 |
| (1) Policy and
Purpose. It shall be the policy of the State | 9 |
| of Illinois that each school
district in this State, including | 10 |
| special charter districts and districts
subject to the | 11 |
| provisions of Article 34, shall submit to parents, taxpayers
of | 12 |
| such district, the Governor, the General Assembly, and the | 13 |
| State
Board of Education a school report card assessing the | 14 |
| performance of its
schools and students. The report card shall | 15 |
| be an index of school
performance measured against statewide | 16 |
| and local standards and will provide
information to make prior | 17 |
| year comparisons and to set future year targets
through the | 18 |
| school improvement plan.
| 19 |
| (2) Reporting Requirements. Each school district shall | 20 |
| prepare a report
card in accordance with the guidelines set | 21 |
| forth in this Section which
describes the performance of its | 22 |
| students by school attendance centers and
by district and the | 23 |
| district's financial resources and use of financial
resources. |

| Such report
card shall be presented at a regular school board | 2 |
| meeting subject to
applicable notice requirements,
posted on | 3 |
| the
school district's Internet web site, if the district | 4 |
| maintains an Internet web
site,
made available
to a newspaper | 5 |
| of general circulation serving the district, and, upon
request, | 6 |
| sent
home to a parent (unless the district does not maintain an | 7 |
| Internet web site,
in which case
the report card shall be sent | 8 |
| home to parents without request). If the
district posts the | 9 |
| report card on its Internet web
site, the district
shall send a
| 10 |
| written notice home to parents stating (i) that the report card | 11 |
| is available on
the web site,
(ii) the address of the web site, | 12 |
| (iii) that a printed copy of the report card
will be sent to
| 13 |
| parents upon request, and (iv) the telephone number that | 14 |
| parents may
call to
request a printed copy of the report card.
| 15 |
| In addition, each school district shall submit the
completed | 16 |
| report card to the office of the district's Regional
| 17 |
| Superintendent which shall make copies available to any | 18 |
| individuals
requesting them.
| 19 |
| The report card shall be completed and disseminated prior | 20 |
| to October 31
in each school year. The report card shall | 21 |
| contain, but
not be limited to, actual local school attendance | 22 |
| center, school district
and statewide data indicating the | 23 |
| present performance of the school, the
State norms and the | 24 |
| areas for planned improvement for the school and school
| 25 |
| district.
| 26 |
| (3) (a) The report card shall include the following |

| applicable
indicators of attendance center, district, and | 2 |
| statewide student
performance: percent of students who exceed, | 3 |
| meet, or do not meet
standards established by the
State Board | 4 |
| of Education pursuant to Section 2-3.25a; composite and subtest
| 5 |
| means on
nationally normed achievement tests for
college bound | 6 |
| students; student attendance rates; chronic
truancy rate; | 7 |
| dropout rate;
graduation rate;
and student
mobility, turnover
| 8 |
| shown as a percent of transfers out and a percent of transfers | 9 |
| in.
| 10 |
| (b) The report card shall include the following | 11 |
| descriptions for the
school,
district, and State: average
class | 12 |
| size; amount of time per day devoted to mathematics, science,
| 13 |
| English and social science at primary,
middle and junior high | 14 |
| school grade levels;
number of students taking the Prairie | 15 |
| State Achievement Examination under
subsection (c) of
Section | 16 |
| 2-3.64, the number of those students who received a score of | 17 |
| excellent,
and
the average score by school of students taking | 18 |
| the examination;
pupil-teacher ratio; pupil-administrator | 19 |
| ratio;
operating expenditure per
pupil; district expenditure | 20 |
| by fund; average administrator salary; and average
teacher | 21 |
| salary ; beginning with the 2012-2013 school year, the number | 22 |
| and percentage of students assessed at each grade level under | 23 |
| Section 10-20.46 or 34-18.37 of this Code and the percentage of | 24 |
| students by gender in each grade level that showed scores in | 25 |
| the range deemed "healthy" on each of the fitness assessments; | 26 |
| and the average number of minutes per week of physical |

| education for each grade level .
The report card shall also | 2 |
| specify the amount of money that the district
receives from all | 3 |
| sources, including without limitation subcategories
specifying | 4 |
| the amount from local property taxes, the amount from
general | 5 |
| State aid, the amount from other State funding, and the amount
| 6 |
| from other income.
| 7 |
| (c) The report card shall include applicable indicators of | 8 |
| parental
involvement in each attendance center. The parental | 9 |
| involvement component
of the report card shall include the | 10 |
| percentage of students whose parents
or guardians have had one | 11 |
| or more personal contacts with the students'
teachers during | 12 |
| the school year concerning the students' education, and such
| 13 |
| other information, commentary, and suggestions as the school | 14 |
| district
desires. For the purposes of this paragraph, "personal | 15 |
| contact" includes,
but is not limited to, parent-teacher | 16 |
| conferences, parental visits to
school, school visits to home, | 17 |
| telephone conversations, and written
correspondence. The | 18 |
| parental involvement component shall not single out or
identify | 19 |
| individual students, parents, or guardians by name.
| 20 |
| (d) The report card form shall be prepared by the State | 21 |
| Board of
Education and provided to school districts by the most | 22 |
| efficient, economic,
and appropriate means.

| (a) Subject to appropriation, each school board shall | 2 |
| require an annual assessment of the physical fitness levels of | 3 |
| all students in grades 5, 7, and 9, which shall be referred to | 4 |
| as FITNESSGRAM and shall be reported on the State Board of | 5 |
| Education's Internet website until the 2012-2013 school year | 6 |
| and on the school district's school report card beginning with | 7 |
| the 2012-2013 school year under Section 10-17a of this Code. | 8 |
| Assessment data must be reported to the State Board of | 9 |
| Education. The State Board of Education shall collect the data | 10 |
| and assist school districts in reporting their data on the | 11 |
| school report card. | 12 |
| (b) The specific physical fitness assessment tool to be | 13 |
| used by a school district must be a standardized tool | 14 |
| designated by the State Board of Education. All of the | 15 |
| assessments must be based on criterion-referenced standards. | 16 |
| The individual assessments shall include the following | 17 |
| health-related physical fitness assessments: | 18 |
| (1) the Pacer test for cardio-respiratory endurance; | 19 |
| (2) the push-up test for upper body strength and | 20 |
| endurance; | 21 |
| (3) the curl-up test for abdominal strength and | 22 |
| endurance; and | 23 |
| (4) the Backsaver sit and reach test for lower back and | 24 |
| leg flexibility. | 25 |
| (c) School districts shall report their raw physical | 26 |
| fitness assessment data electronically to a central collection |

| point designated by the State Board of Education by April 1st | 2 |
| of each school year. The State Board shall then compile the | 3 |
| results, including statewide averages, broken down by gender | 4 |
| and grade level. The State Board shall use this assessment data | 5 |
| to file a summary report every other year, beginning in October | 6 |
| of 2012, regarding the overall status of health-related fitness | 7 |
| of Illinois public school children. This report must be filed | 8 |
| with the Office of the Governor, the General Assembly, and the | 9 |
| Department of Public Health on or before October 31st of the | 10 |
| reporting year. The accumulated data must also be made | 11 |
| available to the Department of Public Health for the purposes | 12 |
| of Section 4 of the Illinois Health Statistics Act. | 13 |
| (d) Students who have a medical excuse from a physician | 14 |
| must be excused from the physical fitness assessment. Students | 15 |
| with disabilities whose parent or physician requests that they | 16 |
| not be assessed must also be excused from the assessment. | 17 |
| (e) The State Board of Education may award a grant to the | 18 |
| University of Illinois for the purposes of data management as | 19 |
| related to the FITNESSGRAM assessment. The State Board of | 20 |
| Education and the University of Illinois shall work together | 21 |
| with a statewide professional organization of physical | 22 |
| educators. | 23 |
| (105 ILCS 5/34-18.37 new) | 24 |
| Sec. 34-18.37. Physical fitness; assessment. | 25 |
| (a) Subject to appropriation, the board shall require an |

| 2012-2013 school year under Section 34-88 of this Code. | 7 |

| 1, 2010.
