AMENDMENT TO HOUSE BILL 3844

AMENDMENT NO. ______. Amend House Bill 3844 as follows:

on page 5, by replacing lines 12 through 14 with the following:

"harm. "Physical abuse" includes actions that cause bodily harm as a result of an employee directing an individual or person to physically abuse another individual."; and

on page 6, line 2, immediately after "in" by inserting "sexual behavior that results in"; and

on page 21, line 14, by replacing "may" with "shall"; and

on page 26, by replacing line 13 with the following:

"statement. Nothing in this subdivision (s)(2) shall diminish or impair the rights of a person who is a member of a collective bargaining unit under the Illinois Public Labor Relations Act or under any other federal labor statute."; and

by replacing page 27, line 25 through page 28, line 4 with the following: "bargaining agreement. If an action taken by an employer against an employee as a result of a finding of physical abuse, sexual abuse, or egregious neglect is overturned through an action filed with the Illinois Civil Service Commission or under any applicable collective bargaining agreement and if that employee's name has already been sent to the registry, the employee's name shall be removed from the registry."; and

on page 32, line 11, immediately after "allegations", by inserting ", the timeliness of the Office of the Inspector General's investigations,".
