AMENDMENT TO HOUSE BILL 4691

2     AMENDMENT NO. ______. Amend House Bill 4691, on page 1,
3 line by replacing "insurance" with "transportation"; and
 
4 by replacing everything after the enacting clause with the
5 following:
 
6     "Section 5. The Child Passenger Protection Act is amended
7 by changing Section 6 and by adding Section 6a as follows:
 
8     (625 ILCS 25/6)  (from Ch. 95 1/2, par. 1106)
9     Sec. 6. A violation of this Act is a petty offense
10 punishable by a fine of $100. The fine for a violation of
11 Section 4 of this Act shall be not more than $50 waived upon
12 proof of possession of an approved child restraint system, as
13 defined under this Act, and proof of completion of a Child
14 Passenger Safety Certification (CPSC) instructional course on
15 the installation of a child restraint system pursuant to

1 Section 6a of this Act. A subsequent violation of this Act is a
2 petty offense punishable by a fine of $500 that may not be
3 waived not more than $100.

6     Sec. 6a. Child Passenger Safety Certification (CPSC)
7 instructional course; child restraint system inspection
8 procedure.
9     (a) As used in this Section, "technician" means a person
10 who has successfully completed the U.S. Department of
11 Transportation National Highway Traffic Safety
12 Administration's (NHTSA) standardized National Child Passenger
13 Safety Certification Training Program and who maintains a
14 current child passenger safety technician or technician
15 instructor certification through the current certifying body
16 for the National Child Passenger Safety Training Program as
17 designated by the NHTSA.
18     (b) A person in violation of Section 4 of this Act may
19 schedule an inspection with a technician. At the time of
20 scheduling, the technician shall notify the person that the
21 child restraint system inspection must be completed prior to
22 the mandatory court appearance date on the person's citation
23 for a violation of Section 4 of this Act.
24     (c) Prior to beginning the inspection, the person must
25 present a copy of the citation of a violation of Section 4 of

1 this Act to the technician.
2     (d) The technician shall be observant for any citations
3 with the notation "no safety seat" in the notes field and
4 discuss with the person, for the purpose of determining the
5 person's need for a child restraint system, the person's
6 reasons for not transporting the child in a child restraint
7 system.
8     (e) Upon completion of the CPSC instructional course to the
9 satisfaction of the technician conducting the inspection, a
10 letter shall be issued to the person for presentation in court.
11 The letter shall:
12         (1) be printed on the technician's letterhead;
13         (2) indicate that the person has voluntarily
14     participated in the CPSC instructional course and received
15     instruction from a technician regarding the proper use of
16     the person's child restraint system; and
17         (3) include (i) the date the inspection was completed,
18     (ii) the citation number presented to the technician under
19     this Section, (iii) the county in which the citation was
20     issued, and (iv) the technician's signature and technician
21     number.
22     (f) Upon completion of the inspection and instruction, the
23 technician shall issue a copy of the CPSC participation letter
24 to the person.".
